Gap Credit Card Debt New Collection Advice Needed

Hi there,

For a few years now I have been in credit card debt with Gap. I had gone through a period paying some of it off to the creditor, Synchrony Bank, then for other reasons became broke and started to neglect my finances.  After several months of radio silence with the store and the creditor, I received this email by a third party, TrueAccord, claiming the creditor, LVNV Funding LLC, now has my account and may take legal action. These agencies look legitimate through my own background check but I'm still suspicious they didn't contact me by mail and I also want to be sure they have the correct information on my case. 

Fortunately, I am now in a position where I can make payments again and would like for this to be a one-time settlement to whom ever holds my account. 

 

Can anyone vouch for Trueaccord and LVNV Funding LLC and for those that have been in a similar situation how should I proceed? 

 

Any advice will be helpful.

is it out of SOL? remember that paying a collections account doesn't make it go away. If it is out of SOL the best action is to attempt a PFD.

Hi Hegemony. A bit late to your comment. This is my first time being in this situation and didn't realize its a bit complicated. So the thing is I have no idea if the statue of limitations have passed. This is really scary and dumb but I dont even know how much interest has incurred since my last payment, though I can guess and hopefully that guess is right.  The last statement I got was from Synchrony bank was late 2018. 

 

What do I do if I dont have any of this information?

1) the store NEVER had a vested interest in this matter...not even if you had used the card to buy a vest

2) SUCKrony has likely sold the account off

3) many entities seem to be using email to disseminate messages and the purchaser would have gotten your email with the other data they purchased

4) a statement in 2018 suggests you would still be well within the litigation window.  Tread lightly, especially if you know LVNV litigates on a regular basis in your area

5) begin keeping ALL documents on ALL accounts, even those that you may have defaulted upon...there is no substitute for having your original documents in order!

LVNV is a junk debt buyer associated with Credit One Bank / The Sherman Group. It is unlikely they would want to arbitrate considering the startup fees are in the 5K range and cannot be rercovered.
