Capital One Credit Card Collection Suit Wins Class Status

Here's a link to the lawsuit that just got class action status.




Here's the text of the offending letter leaving out the boilerplate and specifics for the account.


Dear Valued Customer:

In an effort to resolve the above-referenced account, we are authorized to discuss payment options. We have many

payment options that may meet your individual needs, including breaking the balance into 3 monthly payments, 6 monthly

payments, or 12 monthly payments.


I want to work with you to find a payment solution that fits your needs. Please call me at 877-552-5924.

I look forward to working with you to resolve this balance.

Class action? Really?  What's wrong with you people? Not enough ambulances?

I don't see where Capital One is involved.


Anyhow, I have to agree with Cashnocredit.  They must be hard-up for ambulances in Wisconsin.

Consumer:  "I'm in a bind / need some new yoga pants / my daughter wants rhinoplasty.  May I borrow some money?"


Capital One:  "If you promise to pay it back.  Here are the terms."


Consumer:  "Perfect!  You're the best!"


Capital One:  "I'd like to have my money back now.  You promised."


Consumer:  "🖕 I'm suing."

Going out on a limb here, but

Plaintiff Tom Suxstorf

really SUX and should STORF this frivolous action...


Further, if the 'unsophisticated consumer' understands about debt including interest and fees, then they would ALSO know to ASK about such things in the effort to resolve the matter.  Sounds more like Tom the Numnut just doesn't want to pay the amount he walked...

Sounds just like a phishing email.

Except that, if you actually take the time to read the Exhibit, you would have seen it reads NOTHING like a phishing email...it actually contains more than enough information to allow someone to easily identify the card that they walked and the amount that they walked...Tomas simply wants to be a deadbeat.
