Whychats Hipaa Process- Need Clarification, Help!

  1. I've opted out
  2. Sent prehipaa dispute to CRA
  3. Received verified results from CRA
  4. Sent Medical DV to CA

 

Now this is where i'm confused, do i send the CRA follow up letter, now? Or wait the full 30 days in which the letter states the CA has to provide info? 


The CA received the medical dv on Friday, May 10.  This is for an unpaid account, out of SOL. Set to Fall off Feb 2020.

The instructions CLEARLY state that you should send the follow up disputes to the CRAs as soon as you have proof of delivery of the medical DV

Sorry!  I was a little confused. I went ahead and sent the follow up about ten days after the CA received the medical dv. 

 

Equifax, just completed the investigation for the follow up letter. They verified the collection again.  I never heard from the CA to this day. 

 

What are my next steps?

When did you send the follow up dispute to Equifax?? What response have you had from your disputes to Ex and TU?

The medical collection in question is only reporting to Equifax. I sent the Medical DV on May 9th, and the CRA follow up letter on May 23rd.

What makes you so sure that the latest response from Eq was to your follow up dispute that you SENT on 5/23??

They could not have received it until 5/28 at the earliest. What was the date of their last response??

They actually received on it, 5/25, according to USPS.  They did not mention an investigation was started, i only received an email (June 1st) saying the results of my investigation was complete. Then i had a heck of time trying to view those results, finally after speaking to three reps, i was told that the collection was verified.

I am sorry that you apparently did not understand the basis of the HIPAA program which is to try to AVOID getting caught up in the automated response computerized system of the CRAs. The fact that you got an e-mail response to your dispute might mean that you somehow did not use the "snail mail" method of the program.

 

Your phone calls further aggravated the problem by guaranteeing that your dispute is now firmly ensconced in their automated systems which are managed by outsourced CSRs (customer service representatives ) offshore.

 

Wait another week and try to access your current report by using the "back door". DO NOT use a computer that you have used to sign on to the CRA site before unless you know how to delete the cookies that will automatically sign you in. Go to the CRA website, click on "file a new dispute". You can give the requested data as you will NOT be actually filing a new dispute. This should bring up your current report. SAVE IT-print it out. Once you are done- OPT OUT AGAIN as your actions have automatically opted you back in.

 

Come back to this post once you have a REAL understanding of what has gone on with your dispute.

IF, in fact the CRA has NOT deleted the account then we will give you further instructions.

Ok so i opted again. I checked reports via backdoor and the collection in question is STILL reporting. So what are the next steps?

 

Should i opt out of online delivery of investigation results?

How does this sound?

 

I sent Equifax a dispute on or about April 17, 2019, regarding an unknown medical collection account being reported by CBHBC, LLC Account# *******.   According to my records they received that dispute on April 18, 2019. In this dispute I requested name(s), address(es) of the medical provider(s), the date(s), and type(s) of service, and to whom the service(s) were provided. Equifax failed to do this as requested. 

They stated the investigation could take up to 30 days; I received those results of that investigation on May 2, but dated April 25. . Those results revealed that the item in question was VERIFIED. 

I then sent a follow up letter to Equifax on May 24, in which they received it on May 25 according to my records. My follow up letter stated that i had disputed an unknown medical account with collection agency, as per their instructions and had received no valid response. 

I asked them to advise me to the name and address of the health care provider, the name of the patient, and the reported date of service, as any account i might have had at one would be obsolete. 

I asked them to provide the name of the person providing this data and the manner in which was provided, in case i pursued additional legal remedies. 

Equifax failed to do the following, and verified the unknown medical debt twice. They are continuing to report and refuse to delete the account in question.

Make sure you send a copy with the report # once you get it from CFPB along with the follow up dispute.

Make sure that your follow up dispute to the CRA is addressed to their compliance dept. sent CMRR and includes this phrase;
"I reserve the right to take further action including filing appropriate complaints with the OCR on HIPAA violations and the (name of your State)'s Attorney General under the penalty rules of the Omnibus Final Rule(09/23/2013) interpreting and implementing provisions of the Health Information Technology for Economic and Clinical Health Act of 2009 (HITECH Act), ( your State) 's consumer protection agencies, the BBB and to take civil action to recover damages.
Please note that your Credit Reporting Agency is now subject to Federal consumer financial laws, including, among others, the FCRA and Title X of the Dodd-Frank Act, and related regulations including a ban on “Abusive” Acts or Practices. ( Section 1031 of the Dodd-Frank Act )"

Update! 

 

Equifax sent me a letter stating the account was verified and modified, but remains. 

 

The CFPB complaint is still open, and they said that Equifax is still working to resolve my issues, and that it could take up to 60 days. 

 

Is this normal?

Nothing in any Governmental response to anything is "normal" now a days. The CFPB 's budget has been cut to the bone and their direction is confused and short circuited.

 

If it is showing as disputed and is only on Eq. then chances are it will eventually be resolved.
