2013 Medical Bills for son due to an MVA

My son was in a horrific car wreck on 01/04/2013 (survived though thank you Lord. He was 13.)  I have a bill on my report from 08/2013 which I assume was from a follow up dr's visit? Regardless, it did take a year before insurance settled with us and all bills should have been taken care of before we ever got any personal reimbursement (which to my understanding, this did happen). His insurance coverage is provided by his dad (we're divorced) so even assuming this bill hasn't been paid, shouldn't it be billed to his father?  Not sure what to do here.

Under the doctrine of necessities BOTH parents are responsible for medical bills for a child regardless of which parent carries the policy.  Your divorce decree may spell out more specifically which parent carries the policy, who pays deductibles, co-pays etc. but under the law both parents are responsible for their children's medical care.

When you say insurance was there a personal injury case or did all payments go only through his medical insurance?  If there was a PI settlement I would start with the attorney and see if the claim was ever paid.

If this was a medical bill from 2013 it is WAAAY beyond any valid collection activities. Please ignore the well intentioned but irrelevant advice from "creditsucksnot". ( a little knowledge is a dangerous thing)

I strongly urge you to read the actual SOL statutes in your State ( NOT from your own State of ignorance). A "contract" is defined in all States in their "statutes of fraud" as a either an oral, open or written contract. An agreement to pay a medical provider is covered in each State's Uniform Commercial Code the same as a purchase for services from a plumber or carpenter.

Credit card accounts are "open/ended" accounts and are defined as such in the TILA ( Truth In Lending Act) and unless specifically excepted in your State's statutes are NOT "contracts in writing"

 

If you ever decide to actually READ the legal basis for either the HIPAA letter program or any of the other programs on my website you might be able to participate in the forums more effectively and less obnoxiously . 

 

As an octogenarian ( look it up if your vocabulary is deficient) I have long since become used to ill mannered comments from uninformed people who have delusions of knowledge.

Neither I nor anyone who has been on the forum more than a few weeks advised you to see an attorney. I advised you what to do in my original post. The other posters have been sanctioned by the moderators of the forum and you should pay no attention to anyone with less than 100 posts.

I apologize! You're correct  and I appreciate you pointing it out. For once my overload at work pays off because I haven't had any time to actually do anything regarding this. I will send the HIPPA dispute right now.
