TL/DR: back again to repair some serious damage!

Good Morning!

It has been an extremely long time since I have been here :) Joined in 2008 and spent 3 years cleaning myself up. Sadly, I am back here to document again my repair journey. This time, I am handling my husband's as well as mine - double whammy.

It was a long hard fall from what I had built up. We bought our house in 2011 and everything was looking good. We had moved 3000 miles across country for my job and was settling there in VA. Shortly after we closed on our home, I got laid off.. oy. We used savings to stay afloat until I started my current job. Luckily, I have good job security now so being laid off again isn't a concern. While that was a blow to recover from, it didn't compare to what was to come in 2014.

In 2014, I suffered a ruptured brain aneurysm and had emergency brain surgery. Needless to say, the medical bills were amazing. After the surgery, I was in ICU for a week and was off work for a while. It took my STD a while to start paying out and we had some more savings to try and live off. Shortly after my surgery, my husband had hernia surgery so again, the medical bills started flooding.

During the recovery of 2014, I am lucky I didn't suffer long lasting damage. I still work, walk, talk and can think. During this time, I concentrated on recovering and was not going to stress about the bills I could not pay. It was extremely hard but I recovered. In addition to all this, in 2013 my father died leaving nothing of life insurance so we had to get together with my sister and handle the burial, creditors etc.. and in 2015, I decided that I had been close enough to dying that I didn't want to do that in VA and away from family friends so we packed up and moved back to Cali. Luckily, my job is great and I work from home.

Enough of sappy stuff! Fast forward to now... after my layoff in 2011, I filed Chapter 13 to keep the house and cars safe. After everything in 2014, it was becoming increasingly difficult to make the BK payments as they were quite large. It was causing a lot of stress that I didn't need to add on to everything else. In 2015, I contacted the BK attorney and told them I couldn't do it any more and to let the house go. I was prepared mentally to deal with the consequences. NFCU had the loans to our cars so after the BK dismissed I contacted NFCU to set up arrangements to continue to pay the cars.. there was so little remaining on the balance.

Anyway, I am ready to dig my heels in. Based on what I know between VA and Cali, I am outside the SOL for most of debts which is a good thing I suppose.

I have ordered my reports and still waiting on them to arrive. I received my Experian one yesterday in the mail so waiting on the other 2. I have received all 3 for my husband. Once I receive the rest of mine, I am going to go through and triage them all and formulate a plan. After reading on here the last couple of weeks, I see that not much has changed in regards as to what to do so I can dust off my old stuff and put it back to use. I was mean back in the day lol

Will get my scores soon. I had a friend of mine who is a mortgage broker pull mine so that everything will fall from the woodworks. It is easier to deal with that way. As soon as I get everything, I will continue my post with that I am looking at :) Sorry this was incredibly long!

Shout out to my old friends: Breeze, LKH, Pam, Big Bear, ICANHASMUNY, Hege .. hope you all have been well!

Hey There !

What a rough road life throws at us. Sad to hear of your troubles. Glad to hear that all is well

Just remember, it's not how far you fall , it's how well you bounce.

there's been some new rules on reporting medical, tax liens and judgments due to the State AG's settlement with the CRA's so you need to read up

IT"S A HILARIOUS ( But Important ) read; the Big Three CRA's " Consumer Assistance Plan" VS the Settlement agreements with NY & 31 State Attorney Generals

NY AG 2012 investigation started it all

NY AG Settlement Agreement https://creditboards.com/forums/index.php?showtopic=541303

31 State AG's chimed in for a multistate investigation that Attorney General DeWine aslo initiated in 2012.

The multi-state settlement was nearly three months after New York Attorney General's

Unfortunately, the CFPB has been beheaded, they worked wonderfully on unsolvable disputes when they first started up , not sure about it nowadays

Sweet! Thanks I will get to reading and add it to my stuff lol I had to dust off my old binder with my old letters and Cali law stuff

Got my Experian report and as I thought it is a trainwreck but 95% of the CA’s are all medical. I will probably save those for last so a few can age out some more. I put it all in a spreadsheet so I will update that here today.

OK, so this past week or so I mulled over doing all this again or refiling my BK. After weighing all my options, cleaning up/repairing is the better route to go for me. MANY of these are past SOL in CA and VA so I feel confident enough in my abilities to tackle this head on. I am putting up my accounts here so I can keep track of my own progress as I find it motivating for me as I continue further. I had ordered my credit reports and hubby's reports on January 13 and 14th. Funny enough, I received all of his and only EXPERIAN for me. I have still been waiting on them. When I ordered them through the phone numbers, only Equifax charged me for the report ($8) and the others didn't so I am going assume they sent them as a free report and I will need to order again (sigh).

if you don't want to go the Whychat nutcase letter route,

Riverside is a 501c(3) tax exempt, non-profit organization

https://creditboards.com/forums/index.php?showtopic=524013

it may still not be in Play but the ACA rules for non profit hospitals were when you had your surgery

when was the BK discharged?

and in CA, a payment or acknowledgement of a debt past the SOL doesn't restart it

Baaah it was dismissed Early in 2016 (thinking February?).. I was just going to go the normal Whychat route for the meds which probably will be the first thing I do whenever my reports get here.

So step 1.... I got all my husbands hard copy credit reports.... only received 2 of mine so I yelled at Equifax yesterday.. so that one should be here soon

I decided to begin with all medicals so have my thread over in the medical section to do whychat’s stuff. Hubby’s medical disputes went out first and they received them yesterday so 30 days ticking there...

Will do my medical disputes as soon as Equifax mails me the report....

So I didn’t forget about this lol  I did the medical disputes and some came off and some didn’t.... AND THEN....  broke my ankle in April 😂😂😂  like really!!  Had ankle surgery in April luckily I have much better insurance so I spent $40 total lol

Needless to say things got put on hold while I recovered from that.  Since I am now recovered and walking, it is time to pick it back up again.  I need to order my reports again this next week so I can see what remains and take it from there.

I am excited and ready...  dusted off all the old stuff that I miraculously kept all these years so I will be fully prepared!

  glad to see you're BAAACK  !

:cry2: about your ankle , I've only had a minor sprain once, and that was painful enough !

I can’t even describe the level of suck that was lol Being laid up for two months immobile really messes with you lol

Just happy I am pretty much normal again... mostly just swelling now when I do too much

I am in an internal debate with myself.... I have a first premier (shudder) charge off that reports a balance so I know if affects utilization which in turn affects my score overall.... it hasn’t updated in over a year otherwise...

My conundrum internally is paying this off to get the utilization down but really hating them makes me not want to....

I think I will wait to see what happens as I get cleaner to see if it is something I need to do ..

is the FP out of SOL? if not, that may be another reason to pay it. That said, I would never pay an out of SOL debt unless you get a PFD (something FP is not known for) or you need to PIF to qualify for UW of a mortgage.

Hi Hege ️

It is so within SOL lol charged off Jan 17... they haven’t done anything with it so I am just fighting with myself about it lol

So as of today:

Waiting on my reports to arrive and his reports to arrive. EQ being their usual PITA selves and win’t let me order one will have to try again next week.

I joined SDFCU so that I could get their secured card by the end of this year. I have a Cap 1 secured already. That would give me 4 (5 counting Gamestop card) positive revolving trades.

For him, I will have to do a couple of secured cards probably but will wait and see how his cleans up since I am the only one with dismissed BK.

I will be continuing medical collections first as EQ (again!) left 5 on there and EX 1... I think he is left with one medical on EX. Once those are taken care of (I hope), then will start on what remains. I will list is all after I get reports again. I am just glad I am not starting as bad as I did in 2008 lol

US Bankruptcy Ct   Chapter 13 Dismissed  Filed 9/2012

WHEW....   I know that most of this is just wait it out and I am ok with most of that...     The medicals I started in March 2018 and this is what remained after the initial dispute.  I am restarting that whole process again on Nov 1.   I had broke my ankle in April so everything got put on hold  lol     So as of now I have a plan...     I already have $250 per paycheck that goes into savings...   Starting in November, I will also be paying $205.31 every paycheck to our credit cards.    I am going to lay out my spouses stuff in the next post otherwise this will get super long...     So much of this was in the BK in 2012 so it starts to fall off next year which is a good thing...    Of course, if I can make it move sooner, then I will do so  :)
