Seller going thru divorce - whited out wife's name from contract

I think, though I'm not certain, that seller's wife is on deed. Our original purchase contract had her name on it and she just never signed it. He then, I believe, talked to his attorney and when we had to extend the contract for another reason, whited out her name.

 

I have not questioned him about this.

 

If she has some sort of claim, could this blow up in our face or cause us problems down the road?

Make sure you buy title insurance. The title company will make sure the wife was legally removed from the contract.

Agree with 8ball make sure you (not just bank) has title insurance.

 

but I would go over everything with a fine tooth comb as it sounds like they are doing very shady things. And yes this can delay closing if she is on deed or mortgage.

 

What does your mortgage consultant say?

 

ETA it doesn’t matter what the divorce decree states.
