Equifax dispute problem

I have two accounts that are reporting to my equifax report even thought there outside of New York SOL 5 years.

 

*Macys, DOFD = Sept, 2010

Expected date of deletion: Sept, 2015

Stauts: Charged off, Bal: 444

 

*Visa/DSNB (bloomingdales), DOFD = Feb, 2010

Expected date of deletion: already past

Status: Charged off, Bal: 4,143

 

I need some advice fellow credit repairers!

I am in the process of rebuilding my credit. the above accounts are the only negative threadline I currently have. I reached out to Equifax (via phone) and they denied my dispute to remove the visa/Dsnb account off my report. I was shocked because the Visa/DSNB is outside NYC (5 years) SOL. :sorry::sorry::sorry::sorry::sorry::sorry::sorry::sorry:

 

Any advice will be greatly appreciated. :cry2:

Negative items on your report don't have anything to do w/ SOL. They are scheduled to fall off your report 7 years after the DOFD.

Oh make sense now. I now have a better understanding of the New York SOL.

 

My understanding of New York Statute of limitation (SOL) correct me if I am wrong.

-5 Years - Paid charge off / Closed

-7 Years - None paid charge off / Close

 

Armed with the above information if I stand correct with the above information. I was thinking about paying the $444.00 to OC (Macy's) However, Macys representative instruct me to get in touch with North Land Group (CA) and arrange a payment.

 

I was wonder should I reach out to Northland Group (CA) and tell them in writing. "In a good faith effort to resolved this matter amicably. I am willing to offer a payment of $444.00 on the condition that your client, in writing, considers this alleged account to be paid in full, and this matter to be closed." If they agree, I think the CRA will remove the Neg TL from my report.

 

The Visa/DSNB, I still pondering how to approach this alleged debt.

expected date of deletion, is this your own or what it says via equifax report?

This is what Equifax rep disclosed to me over the phone.

New York's SOL has zero impact on your credit report. It impacts whether or not you can be sued. If you simply paid in full it can still report for up to 7 years after DOFD. Your best bet is to ask the creditor for a pay for deletion.

Actually NYS consumer law does dictate how long a paid collection/judgement can report (a max of 5 years).

 

 

New York State Consolidated Laws - General Business Law
ARTICLE 25
FAIR CREDIT REPORTING ACT
380-j. Prohibited information.
(f) (1) Except as authorized under paragraph two of this subdivision,

no consumer reporting agency may make any consumer report containing any

of the following items of information.

(iv) accounts placed for collection or charged to profit and loss

which antedate the report by more than seven years; or accounts placed

for collection or charged to profit and loss, which have been paid and

which antedate the report by more than five years

PFD Was rejected. I will just pay the alleged debt in full, just so it can be removed off my report so it can stop impacting my score so dramatically. It's only $444.00.

 

The $4,000+ alleged debt has fell off two out of three of my reports. It's only being reported by equifax. I will attempt again to see if I can have to delete via dispute.
