ERC hit all my reports with a collections account for DirecTV. I was going to send them a DV letter, then I went through my garage and found some of the old equipment. So I'm unsure of what step to take.

 

Option A: call DirecTv and negotiate a deal for returned equipment with an agreement for removal from credit reports

 

Option B: send DV to ERC.

 

Keep in mind that when I first started my journey, I disputed this DirecTV account when it was owned by NCO Financial and it got deleted. Now it's been reinserted. It's also wayyy past SOL as well.

I've been trying to figure out if this works for old collections or only ones you catch immediately after they are assigned to a collection agency. I only have one collection on my reports; a five year old AT&T collection for $132 with Enhanced Recovery for a landline I had with an ex-girlfriend after I moved out. I closed the account, the final bill was mailed to the service address, she said she paid it, and when I discovered it on a credit report I paid AT&T directly and in full. I asked the AT&T collections person if they would withdraw the collection, and they said they would, but it appears it is just reporting as closed and paid in full instead.

 

Since this is the only collection on my report, I'd rather not wait two more years for it to fall off. I've been looking for the best address to send a goodwill letter to AT&T expressing my desire to preserve a good relationship for future services with their company, briefly explaining the circumstances, and requesting a goodwill withdrawal of the collection from the agency. Does anyone know if AT&T Corporate, P.O. Box 772349, Ocala, FL 34477 is the best address to use, if I would have better luck with a public facebook inquiry instead, or if the process referenced in the thread above is still valid for very old collections?

She paid the OC ? If so, you're going to send the letter from Shifters thread(change it up to suit your situation) to the CA.

I paid AT&T directly about 3 years after the CA first reported it to the credit bureaus when I was denied for a credit app, the bureaus and ERC got my new address and sent fresh collection letters, and I saw it on the credit reports I requested with the denial letter. I was bad credit years ago, then no credit for years, before recently accepting that having good credit is a necessity in the modern world, even if you don't want to borrow money (except for a house).

I think the part that is confusing me is this: "Please note that under Restatement (2nd) of contracts, that if an obligor makes payment to the Assignor before the notice of assignment is provided, the debt is discharged." The topics I've read that reference that letter seem to be regarding NEW collections during an initial window. Does a CA have to remove the collection from your report entirely any time the OC accepts payment directly?
