ok so here is my pickle many have helped me and I hit a wall. I lived in NY from March 2013 to August 2014 after being medically retired from the army for injuries sustained in Afghanistan in 2011. I was borderline homeless wasn't due to loving family but had little to no money coming in while waiting for my benefits for months and relied on family and gracious organizations that assisted us to survive. I got divorced in Texas and had 2 kids with my ex and had child support well obviously I fell behind during the time period mentioned and Texas thought I was being a dead beat and sent enforcement only to NY. Well before NY started enforcing I got my benefits and was paying to Texas, then NY stepped in and started garnishment and realized what happened and contacted Texas, well I did and then right before moving to Texas to be closer to my kids since my life had been put back together. Fast forward to post move. I notified both NY and Texas of the move and Texas said they were going to take back over the enforcement. October 2014 Texas sends me all the usual paperwork when someone takes enforcement. I then dispute the NY DSS account with all 3 and it was verified. I then contacted NY and was basically called a deadbeat in not so many words and said I owed what I owed, I then called Texas and they gave me all updated info amount still in arrears and all up to date payment information well to my surprise the amount Texas told me was a third of what NY was reporting. So I send that to the credit bureaus and still verified. Eventually I threatened lawsuit with EQ because of this and they deleted with a swiftness, EX and TU became pains in the flowers and stood their ground, so over the ensuing months multiple times for each totaling what I could find was at least 21 verifications between the three CRA. I have sent the documentation to NY proving they are more wrong than two boys kissing in church and they told me they can report whatever they want. I want blood now as this has effected my financial mental and physical well being, it is illegal since they have no jurisdiction since October when Texas told them the first time to close the case and they have ignored they also have been garnishing my combat disability offset pay which I was told if there is no permissible purpose nor legal authority it is a serious felony offense. Now mind you I, my ex, my children are all Texas residents, the divorce and child support was out of Texas, the payments were going to Texas. I know I can't sue to state but I can sue the county and possibly sue the CRAs still reporting what is the advice if any and infractions other than reporting and validating obvious incorrect amounts, the fact that the case is reporting and verified as open when it should have been closed months ago, and the fact that they are reporting not as enforcement only but as if the case itself is owned by them. Anything will help as I plan to stick it to them and hard.

In the divorce child support was ordered. well obviously I fell behind during the time period I lived in NY while waiting on my benefits, and Texas thought I was being a dead beat and sent enforcement only to NY.

I do apologize for the incoherent ness of my first post as stated before my injuries one of them is Traumatic Brain injury and this situation has severely impacted this part so hard for me to write explanations normally.

Unfortunately nothing is solidified as he is still reviewing the case but I do intend to sue with an attorney. I live in Texas now so kind of hard to do that locally in NY. I also did a complaint with the NY AG they basically told me its my problem.

I also usually have my wife proofread, or a friend because as you can tell sometimes it's hard to coherently write my thoughts. Kind of sucks but such is life. Thanks ICAN any other advice or other possible violations to sweeten the pot?

I really think the news media backing and public shaming of the Agency involved is your best bet going.

That's what another guy had to do before an attorney took the case on FJ Hanna, which you just read.

 

Veteran's issues is good story, and so is debt collection and credit reporting agencies.

 

AND you've got all three in one bucket,

 

Find some local TV news reporter that routinely covers veterans stories and contact him/her.

 

pull up one of the news websites and run a search of articles on veterans.

 

or try the NY times - they like to crucify NY state agencies
