I have a dispute with EQ that I filed electronically (before I found this board).

I submitted the documents they requested at the time of the dispute:

  • Driver's License
  • Social Security Card
  • Current Utility Bill
  • I also sent a copy of my Birth Certificate

I then received a request for the same info using the same Confirmation #. I sent it to them by fax.

A few days later I received a request for the same info using the same Confirmation #. I sent it to them by fax.

A few days later I received a request for the same info using the same Confirmation #. I sent it to them by fax.

I have again a request for the same info using the same Confirmation #. This will be the 5th time I will be sending this info and on each of the prior times I wrote on the fax transmission report, "2nd, 3rd, etc time this info is being sent."

Each time they request this info when I check the status of the dispute the date is changed to reflect the date of the most recent request and the Confirmation # stays the same.

Question:

When resubmitting this same info again should I threaten a CFPB complaint?

Should I just go ahead and submit a claim anyway?

Should I demand that the date be changed back to the original date?

Any suggestions?

(And yes, I know now that the dispute should have been done in writing so there is no need to re-enforce or bring up that issue)

Thanks in advance.

what exactly was the dispute about?

if it's just ordinary credit repair, that's one thing, if your disputes are regarding things like a mixed file, or accounts that are not yours, you need to find a lawyer

because a woman in Oregon had a mixed file that harmed her credit for years , and they pulled this same tactic. EQ should know better.

http://www.nbcnews.com/business/consumer/woman-wins-18-6-million-two-year-battle-over-credit-f6C10772195

Miller v. EQUIFAX INFORMATION SERVICES, LLC, Dist. Court, D. Oregon 2012

the jury awarded here 18 million in 2013, but it was reduced to 1.6. in 2014.

Plaintiff alleges that she requested a copy of her credit report from Defendant in December 2009 after she was denied credit.by a bank. On or about January 5, 2010, Defendant requested Plaintiff to provide additional identifying information, and Plaintiff complied with the request on or about January 11, 2010. On January 21, 2010,[1] Defendant provided Plaintiff with a credit report dated January 18, 2010, that included allegedly false identification information, an incorrect Social Security number and birthdate as well as derogatory collection account information improperly attributed to accounts belonging to Plaintiff.

On nine separate occasions between January 2010 and September 2011 Plaintiff disputed the allegedly incorrect information in Equifax's January 18, 2010, credit report. Nevertheless, Defendant continued to send to Plaintiff the same form letter repeatedly requesting additional identifying information, and on each occasion, Plaintiff provided the requested information.

In the meantime, Plaintiff alleges she was denied credit by Key Bank on March 2, 2010, based on information in her Equifax credit report.

On September 28, 2011, after the last letter from Defendant requesting further information, Plaintiff brought this action under FCRA.

Original dispute is from Midland Financial reporting an inaccurate address. An address that I have never been connected with. The only connection is that the people who live there have the same last name as I do by coincidence only. I found that out by our local property tax records. I have disputed this with all three CRA's and so far they have came back as verified.

I have sent Midland a DV and so far I can tell that the TL's do show a “Customer Disputes etc” but I am still awaiting on Midland's response.

See this thread elsewhere on CB for the letter sent to Midland to avoid duplication here on this thread.

I know that Midland reported this false address as I have a taped phone call with TransUnion, verifying that Midland was the reporting agency. On EQ it is also very obvious that it is Midland reporting this same info just by matching up the dates of the first reported and last reported dates of the erroneous address with their TL. I initially placed a fraud alert on my file with TU, and they subsequently notified EQ and EX. Midland also reported false phone numbers as verified with TU.

Midland has verified both TL's so far. They have one with the erroneous address and one with the correct address. No excuse for the false address.

In the initial dispute I was asked to send:

  • Valid driver's License ~~ Check

  • Soc Sec Card ~~ Check

  • Utility Bill ~~ Check

  • I also sent a copy of my Birth Certficate just so....

I have received four separate requests for this info since. Which will make it FIVE times they have gotten this info.

What's worse is that each time I am asked for this info the “Date of the Dispute” gets pushed back a few days.

Thanks for that link. I have not answered the last 'request' yet as I have been busy the last few days.

Maybe I should reference it on the next fax to them and provide the link also.

I have looked for a contact number on their website but all I have seen is numbers for “existing customers” and I don't have a subscription to any of their products. And truthfully, as I said, I've been kind of busy the last few days anyway.

And BTW, you asked:

what exactly was the dispute about?

if it's just ordinary credit repair, that's one thing, if your disputes are regarding things like a mixed file, or accounts that are not yours, you need to find a lawyer

It was an ordinary dispute, and being I did not recognize the OC, which was connected to Midland's TL I placed a fraud alert on my CR too. Turns out it was an old Providian CC that was bought out by WaMU and then bought out again by Chase. So the fraud alert wasn't really needed after all. And I have not been denied any credit because I haven't applied for any. I wanted to see what was currently in my CRA's reports before doing so. It has been a very long time since I have checked my CR's or had any need to.

Thanks

Providian was bought out in 2005 by WAMU and them Chase bought out Wamu in 2008

you originally stated that DOFD on Chase is 11/2008-

but you didn't recognized Chase bank ?

whom was the last lender the account open and usable with,

with whom did the default occur & when ?

Chase has been in the OCC gun sights for selling off bad debts with shoddy records and there is a OCC order out on that.

reason I'm asking; this may be past the SOL for reporting too, illegal reaging.

Equifax is as dense as a brick that you would throw through a car window. Cinder block, even. Whatever they throw through car windows these days. Equifax is denser.

Also, OP... Could you have a split file? Maybe Equifax is having some trouble identifying you.

Also, they are very, very stupid. I don't want to get into how I know!

(Also, all that "documentation"... if you use an address that a creditor gives them, they won't ask you for anything. God forbid the creditor gives an address you never lived at, let's say, from a fraudulent account. They will call YOU the fraudster.)

I didn't recognize Chase because I only had a WaMu card. Opened in 11/2005 (I had had an old Providian card also that had been closed by then)

I found an old CR dated 03/2006 showing that I opened WaMu in 11/2005.

As to the DOFD - when I read your reply *Bells went off* ~ I never had a Chase card, all of my financial troubles began at the end of August 2006.

The only card that I tried to keep after that date was Home Depot - just so if I need to make any emergency repairs to house, etc.

All other cards were let go in an attempt to save the house.

According to Chase, I kept up my payments throughout 2007 and up until Nov 2008 which at the time would have been virtually impossible.

The last card I used would have been a WaMu - not Chase.

I have a separate dispute in with EQ regarding Chase - so far I have not received any "Request for Additional Information" ..... yet. Asking for ALL info related to that TL as it is also related to Midland.

I have a CFPB complaint in against Midland also and the 15 days are up on December 3rd. I've had no response from the CFPB or Midland yet either.

Thanks for those links. I had one of them already from another thread that I think it was you that posted it.

On another Midland related item:

I disputed Midland with TU and of course it came back as verified, however, on the original CR I used to dispute the Midland TL's neither of them had an entry for the "Date Closed"

After the TL's were verified there is now an entry in the TL's as "Date Closed: 11/15/2014" and "Date Closed: 11/7/2014" and both are now listed as disputed.

Does that affect anything because other paid off accounts, etc have entries showing the 'Date Closed' dates as when they were paid off/charged off?

Thanks

Edit: I called Chase re: removal of TL just to see what they would say. The lady wasn't very friendly and only said I had to contact the CRA for removal.

Sounded like somebody had already burned her Thanksgiving turkey, and she was the turkey.

I am beginning to believe you.

On the original dispute I sent them a copy of my deed dated 2002 and a utility bill with a due date in Nov 2014 showing my service address and my mailing address (PO Box).

Then they started asking for my ID's repeatedly.

I didn't answer you earlier but I shouldn't have a split file.

My entire file can't be that large.

Maybe 15 TL's total, 7 or 8 total inq's including mine and 3 addresses if that means anything.

Can anybody tell me if the above negatively affects my FICO scores?
