Even though an OC has a debt being collected on by a CA, if I send a DV letter to the OC to find information on the account doesn't the OC have to respond to my request per TFC law?

Unlike the FDCPA, an original creditor is considered a collection agency and they must respond within the thirty day window to a dispute. However, in this instance, the OC is not collecting the debt and a third party is. Have you tried sending a FCRA 623 letter to the OC? Did you dispute the CA citing the TFC 392 ?

A consumer has to dispute with the CRA (s) first. If the debt comes back as verified by the CRA, A CA must comply and respond with a 623 letter or face fines up to $ 1,000.

My situation is mercantile adjustment bureau is the CA located in buffalo ny. They are collecting on a medical bill and utility bill both accts are from 2008. I contacted both OC and the med bill is from a hospital and they don't have any record of the bill. They don't know if they have a bill on this account but they said the records of me being seen are available, go fig huh,??? I spent 4 hrs on the phone the other day talking to the billing and records dept in the hospital and nothing was found as far as a bill goes but.its showing on my credit report. I also contacted the utility company and they dont have any record of my payment history so now im ready.to send my dv letter to the CA, and the CB and the UW that holds the bond for the CA
