Portfolio Recovery Associates - Won't PFD..What do I do?!

Hi all - I've been trying to clean up my credit & like many people have some bad marks from years past..unfortunately, two of them relate to Portfolio Recovery Associates which is seeming to be IMPOSSIBLE to deal with.

 

1. I had a store credit card that I fell late on and it went to collections in Feb. 2013. I called and for someone to agree to a Pay for Delete so I paid the entire balance in Dec. 2013. I later found out this was the worst idea ever because they didn't delete anything and seeing I trusted their word, I have no proof that that was the agreement. So now I have this account sitting on my credit report as Paid in full, was a collection.

 

2. I had a Capital One card with a limit of $300 that went to collections in Mar. 2013. It's now showing as purchased by PRA in June 2014 with a original amount of $581.00. I'm not sure what happened to Mar 2013 - June 2014? I don't see anything else on my report for this account in these months..

 

Any ideas on what to do with this company, they won't agree to a Pay for Delete but I'm really hoping to get this thing of my reports! I've seen people mentioned requesting validation and I've thought about that but I'm a bit confused on the whole process..

File a complaint with the CFPB and ask for monetary damages.

Also, no PFD agreement in writing = no payment. Period.

Thanks all - yeah I learned about the no PFD in writing, no PFD at all the hard way!

 

I've thought about filing with the CFPB for the account I paid but wasn't sure what to use as reasoning.

 

Any ideas on how to handle the open account with PRA - they aren't proving to be very easy to work with!

On my credit report it's listing:

Remarks: DISP INVG COMP-CONSUM DISAGRS: >PLACED FOR COLLECTION<

 

I never filed a formal dispute with them and never received any notice of any type of dispute.. I called and offered a PFD and they refused...but I know 100% I never spoke to anyone in a dispute department or anything, they kept offering to transfer me to file a formal dispute request but I refused.

 

Any knowledge on if I can use this inaccurate information as means to have it deleted or is it not enough?

It's not uncommon for CA's and OC's to report pretty much *any* communication from the borrower as a "dispute". It doesn't really mean anything, *except* if you're applying for a mortgage. (mortgage underwriters don't like to see open disputes, and will tell you to resolve it. I suspect that's why CA's are so quick to report disputes - they figure it gives them added leverage)

As far as the second account, dispute the amount with the CRA(s). If the report shows the dispute was verified with no other explanation, file a 623 dispute with the OC. The OC must verify the information it has in it's files or face fines.
