Xpost from Idenity Theft.

I have sent block letter per FACTA to Experian along with FTC Affidavit, police report, driver license, social security card, utility bill (for address verification) and received 2 page letter from them after a month of investigation.

Basically here what is said on the first page "If you still wish to have this information blocked, please submit an identity theft report without the deficiencies noted at the end of this letter".
At the end of the letter is noted "The identity theft report that you provided to us does not meet the guidelines established by the federal Fair Credit Reporting Act for the following reasons(s): It was not filed with a law enforcement agency which subjects the person filing the report to criminal penalties relating to the filing of false information"

Can someone explain what is this response and what is my next step? This is unbelievable. Equifax and Transunion diligently blocked within 24 hours of receiving.

they want a police report. I had to go to a Police Dept and file a report on a two time fraud totaling $182 on a closed account under a different married name at an address I had not lived at in 6 years. No Shitola. However, it finally worked. FINALLY after 6 months. The police understood but they think it is crazy, I was not their first person doing it for Experian.

 

Nice to know that we are using their time productively...!

I take it that you have a report number and a copy and a description.. I uploaded mine three times to EX... and make sure that the CC co gets a copy, even go to the PD and have them certify it... It is absurd but I finally broke down and did it and about 4=5weeks later with MANY phone calls I got it removed. It was quite lovely. I HATE DELL.

 

Now, altogether, lets sing " I hate Dell, Dell is from Hell"

I got my free Experian CA freeze, but in addition to the police report, I also included the CFPB affidavit that was notarized, but for my DW, we had to try twice, the first time they just put a fraud alert on the file, second time they renewed the fraud alert and put the freeze in place. Just let the fraud alert run its course so as to not mess up the freeze. It is discussed here: http://creditboards.com/forums/index.php?showtopic=527635

 

BTW, it is not just $5 in CA, it repeats with each lift and it is $10 per instance in CA, it is nice to have the fee waived for a process that is online and involves no human intervention on their side.

where did your police report come from?

 

basically they're saying where you got your report isn't legal enough for them.

 

I filed at the local police station with a police officer. They gave me preliminary copy first, then a few days later went back, paid $5 and got the full report which had more information.

 

I am not trying to put a freeze, I am trying to remove fraudulent mortgage and BK. I don't know whose the BK is, but it shows up only on EX and nowhere else. I am suspecting the BK is someone else's, since it shows up only on one bureau.

 

I don't know what is next for me. Just came back from police station, where I asked them to certify, they said there is nothing more they can do, since they already took the report.

 

Any advice?

Fill out the FTC affidavit, get it notarized, and have the police report attached to it.

 

Or call Experian, ask for special handling, and talk to someone who can get things done. You just might have to deal with them forever though (special handling)...

Explain to them how they've been sued for this crap before Osada V. Experian, pulling the above mentioned stall tactic. When the court accepted the settlement one condition was that experian would refrain from thus and similar tactics. Google Osada just include it. That should get the attention. I believe it was settled in 2011, Illinois consolidated with Kimberly Hovenac or something like that. Either way follow the above posters advice. Good luck

It meant they sent you a standard form letter , probably lost your documents. call Experian's fraud debt and state you're going to file a CFPB complaint over this.

 

watch how fast they move then.
