I sent a FOAD letter to Portfolio Recovery Services on August 21st. They're attempting to collect an alleged debt that is pasy the SOL. The credit line for the debt is off my credit report, but Portfolio continues to come up in the "account review inquiries" section of my report. The last time they pulled my report was September 9th.

 

My question: does portfolio have a legal right to check my credit report? I have told them I won't pay and not to contact me anymore... are they violating FCRA? Does the (soft) inquiry negatively impact my credit score?

if it's just an AR, no it shouldn't impact your score at all.

 

and no one can see it but you and the CRA.

 

are you sure it's beyond the SOL for your state?

 

a few states are longer than FCRA reporting limits

They can pull hards whenever they want if they have a court judgement on you. This activity in itself can destroy your

credit score and it amazes me there is no law against the practice. A zombie collector did a hard on my Experian about

a year ago but luckily I have not heard a peep out of them since.

No court judgement. Definitely past the SOL (fell off my credit report already). As long as they're not hurting my score, I guess its not a big deal.

 

I just hope they don't start with the calls again - good thing I kept all my records of the FOAD delivery.

SOL and legal reporting period are two unrelated concepts.
