So I've had Eastern Account Systems as a thorn in my side for a few years now. They're reporting twice for an old Comcast Bill (Comcast was paid in full, I have proof of that). I've disputed that they were incorrect and are reporting in duplicate with EX but of course EX keeps verifying and refuses to investigate further.

 

I've sent out one last dispute letter to them but I'm really considering suing for violation of the FCRA/FDCPA if they don't delete this crap already. What would I have to do to file suit? Can I just file in my home county (I'm in NJ) and pull the CA trick of trying to get a default judgment?

Hi, I would contact a FDCPA consumer attorney and give them some basic information and they will then contact you. Just surf the web for 'FDCPA consumer attorney' and find one that practices in your state. Most of these consumer FDCPA lawfirms take cases at no cost you. They obtain their income from attorneys fees. In addition, the plaintiff, that would be you, would probably receive a check too. Adding court costs,attorneys fees and the punitive award adds up quick to help in the behavior modification of bad CA's.

So to update on this, I sent the CMRRR dispute to the CA.

I then decided to get Comcast involved (I'm a current customer - the collection was an old account.) I e-mailed the EO with proof that I had paid the bill and informed them that not only was the CA reporting wrong but they were reporting twice. According to the EO they 1) aren't supposed to report separately for equipment and bills they should only be reporting ONCE and 2) they hadn't gone even BACK into my account after I paid it to Comcast to look at it. They sent a letter off to the CA telling them to update it (which I'm supposed to be receiving). That might take up to 60 days depending on reporting but in the meantime I'm taking action against them myself to get them to delete.

 

I'm going to give it a few days and wait and see what happens.
