my complaint with the NY AG was registered after screening on June 16th... This is the process... they send a letter of concern, if valid, to Experian. they wait about three weeks A second request is sent with a copy of the complaint after another two weeks( 5 weeks total). If the situation is NOT resolved, they contact the company verbally and try to suggest "voluntary mediation" obviously presenting it as valid.

Ms. Andrienne Walters of the AG's office, Bureau of Consumer Frauds and Protection, has only received TWO complaints (Bravegirl, they hear you)... they need more for more formalized legal action. They believe that the complaint is valid and cogent.

Ms. Walters can be reached at 519-474- 5481. She is aware of the issue and it is already 'screened". She WELCOMES more complaints as they need more to take legislative action. Until then all that they can do is to strongly suggest that the issue be mediated in the consumer's favor, assuming it has been screened.

address is: Ms. Andrienne Walters/ AG's office of Bureau of Consumer Frauds and Protection/The Capitol/ Albany NY 12224-0341. Although it is better, letters do not have to be CMRRR...

Please, if this issue of Experian not purging a paid account after 5 years from DoFD or not removing both the OC and the CA applies to you, you will save two and a half years of waiting for the fall off. I strongly urge you to write off a quick letter or you can PM me and I will send you a template.

Good luck... and don't complain- write a letter because they are on it and need your support to make this not a letter by letter case...

thanks to all/ MizLiz

I would suggest you have an incorrect phone number.

The area code for Albany, NY is 518

sorry, 518 it is... was trying to type it in quickly...thanks!

re oher questions-

The, NY AG, will respond to individual cases with strong prejudice but they need to hear from more constituents in strong and clear language as to how this affects them as consumers and specifically how Experian refuses to honor the statutes of New York vs the other two agencies... Also that Experian will not honor that you cannot pay twice but will keep the OC on after the CA has been paid even if amount agreed to in court of law under judges supervision. Again they need more cases to press legislativě action vs individual response. PM me for outline of letter. Net effect is that they agree with our position but need numbers to press the point. Thanks to all considering such a letter... So many are affected by this.

I'm curious to know if this will actually change the nys law or will enforce experian to abide to the current law for the future.

Then again, it might just help those who speak directly to the NYS GA.

For the the future, come a years time from now, will someone need to go through this crazy process?

Screening means that they have reviewed the complaint and that the references to NY law are correct and that the issue presents a conflict to consumer law or a specific statute. In other words, it is not a nutcase letter or a rant.. and that it is specific so far as breach of law or consumer fairness and/or injury.

They are strongly recommending to Experian that it abide by NYS GBS 380J and that they accept the CFPB def of "paid" and that they don't double register OC and CA after payment... these are the three issues. Bravegirl, I believe, followed my format letter and included her own personal information. I also included that I could not get a credit card due to Experian's report and that I was turned down for an apartment lease. They are looking for personal "injury" to a consumer, if possible. The issue of consistent CRA records is also an issue.

They can recommend that the code be "tightened up" (my quotes) to the Legislature if there are enough complaints about this issue but two letters is hardly a groundswell. Because we have a specific name and address and issue, you can probably skip the CMRRR/// yes, it will be a crazy process unless more people make it an issue. That is what happened in Mississippi...it is sort of like a cancer cluster... the first two or three may be convinced but the next 50 seal the case. One lousy letter- thats all you have to write to pull off 2.1/2 years of devilment on your OC's ...

PM me for format to put on your computer... they will start to be more forceful if they don't think that these are isolated experiences at Experian with respect to this issue or other Experian Devil issues that many on this board have. They can't respond until they are told what is happening...
