JDB accepted my settlement offer - THEY pay ME for violation?

Okay...I'm not sure what to make of this. I need some pro help.

 

I just had from a JDB who made ONE call to me this week, on which I immediately filed complaints with CFPB, FTC and FCC -- it was a robo-call for a fictitious payday loan. I get a new scam operation calling me every month, and I'm not playing around anymore. I have an attorney filing suit on 2 in GA this week, and this one is in the Buffalo, NY area...imagine that.

In my CFPB complaint, where it asks what a "fair resolution" would be -- I said I would accept $1000 from the CA for this violation of the FDCPA and not charge them for the TCPA violation. I added that this would preclude them from selling this BS to any other entity.

Their Compliance Manager just called me to "ACCEPT MY OFFER" and pay me $1000 -- their attorney is sending the agreement overnight as soon as the the docs are finalized today.

HUH...?!

He clearly stated that he would accept my offer to pay me the $1000 for their violation.

 

Here's what my CFPB complaint said:

As of today, (date here), I am willing to accept $1000 as a settlement from this company for this

violation of the FDCPA; and I encourage them to accept this as my "final" offer before they rack up

additional traceable violations.

I already have 2 others with at least 6 violations EACH, who admitted them to the CFPB -- my atty friend in GA is sending the demand letter this week, as THOSE morons are located in GA. :D

 

Edit: If they don't accept the settlement demand, he'll file suit.

I get these calls all the time. It would make a nice part-time income to start cashing in on these. :lol:

Wow. I've never gotten a payday loan call. How do you get on these phone lists? Sounds like a work at home business opportunity.

 

1. Get on a payday call list. (but not by getting a payday loan!)

2. Collect the most ridiculous and egregious calls.

3. File complaints and offer to settle.

4. Cash the checks.

 

What is even better is that if lots of people did this the industry would have to clean up it's act. Doing well by doing good.

if a small loan, the relatively small amount you'd pay in interest would be greatly offset by the large paydays that could be acquired.

That changes the whole meaning of "payday loan." :rofl::rofl:

 

 

I suspect just entering your information on some of the internet payday sites would do the trick. I sure wouldn't do it and it was really a tongue in cheek suggestion not to be tried at home without some real guts and willingness to put up with the associated crap. If people are doing this it's probably under "fight club" rules.

I can only tell you how I ended up in this ridiculous scenario. I went fishing for a payday loan online early 2012, and I THOUGHT I was plugging all my info -- bank account, ABA routing, the works -- into the LENDER'S site. (NOTE: I don't have to tell any of you how stupid I know this to be TODAY.)

 

It was a "broker," of sorts -- they farmed out my info to every Tom, ding-a-ling & Harry who paid to be on their "lender" list.

 

I accepted ONE OFFER for a "legitimate" loan (that sounds ridiculous) that came with full disclosure and required my electronic signature. I paid it back within contract terms. The End...

...of the legally performed activities, that is.

 

A few months later, I'm getting calls from cretins who are "with the Process & Summon's Division" of a variety of states and counties. They called my employer; they called distant family who I'd listed as "references" on the aforementioned payday loan "application"...and they DO NOT GO AWAY. The players change every few months, but this has been going on for 2 years.

 

And I got SICK OF IT. :dntknw:

This doesn't sound like intentionally getting on this list is worth the trouble. It seems like they are just playing the odds. People who have to take out payday loans are the type of people who default on this stuff. Randomly calling someone on that list and saying they owe money on an unpaid bill is a high percentage gamble.

Sadly, the odds are WELL in their favor. And many of us who find our way into that Cycle of Hell known as payday loans don't have good records and may not recall WHAT we borrowed from whom.

 

I'm just grateful that I don't fall into that category -- it's so easy to do. Regardless of whether they have any legitimate claim against a given consumer, they CANNOT legally do this kinda crap. (But we all know that.)

I emailed it to my attorney (friend) to review. :wave:

Yeah, I'm just doing my best to remain neutral on the whole thing until the check arrives. No charge from my attorney-friend for the agreement review, only because we had to put up with each other in high school. ;) I expect him to charge me for the others he's handling in GA, of course. But this was a simple review of a 1-page agreement, and he made a couple of important changes for me to propose.

 

I won't trust this until I hear the fat lady sing. :grin:
