What is my next step to get these inquiries removed?

reading my subject probably made half of you cringe. I feel that I have 3 mortgage inquiries that should not be on my report. I have read numerous times that you should never dispute inquiries. So here is my little story.

 

My short story is: I applied for a mortgage loan, they did a pull, never contacted me back, I did a BBB dispute, they replied, I replied to their reply, it came back today as unresolved.

 

The long story: On 02/23/2014 I submitted an app for a mortgage through Howard Hanna's website. Removed name contacted me via email on 02/24/2014 with a few questions. I responded with the answers and was told my application would be sent to removed name and he would be in contact with us. I emailed removed name back and asked if my app could be sent to an office closer to where we wanted to buy a house. removed name never responded to my email. On 02/27/14 I emailed him again to let him know that no one has contacted us. Again I did not get a response from him. As of today 03/08/14 no one has been in contact with us about our loan options. A few days ago I received our disclosure when they ran our credit. Now we have a credit pull and this company has not cared enough to ever contact us. If they did not want our business then they should have been up front. We are not happy customers at all and I will never recommend this business to anyone.

 

Their repsonse: They submitted a letter to BBB and said they are sorry this had happened. They confirmed my above story as well. Their explination was that the person who was supposed to contact me got ill and took some time off. They didn't have anyone check his email so my info slipped through the cracks. Upon his return he still never contacted me and they are internally going to investigate why.

 

My response back to the BBB: I can understand that thing happen within a business but it is unacceptable when it means damaging our credit and possibly preventing us from obtaining future credit with other lenders. Because of their admitted negligence our credit is going to be damaged for 2 years because of the 6 credit inquiries that will remain on our file. We ended up getting pre appoved with a new mortgage company but because there was a long delay in waiting for Howard Hanna to respond the inquiries will not be grouped together for scoring purposes. The only acceptable response will be for Howard Hanna ro remove the inquiries that they placed on our file.

 

 

So what is my next move? Should I file a complaint with the CFPB or are their other avenues that I have?

Sure. I would file a CFPB complaint. And if that doesn't solve it I would send another letter to Hanna advising that due to the length of time of no contact from them, you were forced to go elsewhere. Also, the length of time made their hard pull non-permissible and they now owe you $1000. You likely won't get it but you can certainly try.

The validity of your frustration notwithstanding, when I last refinanced I ended up applying with four lenders, all of whom pulled all three bureaus. This was during a major refi boom and some were awful at getting back to me because they had staffing constraints. I just ditched them and moved on.

 

For FICO calculation purposes your mortgage inquiries, regardless of how many, within X days (I've seen 30 bandied about), are considered one since people are prone to rate shop.

 

IMO, move on and app somewhere else. Your aren't "damaged" in any way, and you've already put more effort into this than its worth.

 

It's better to find out at application time that your chosen lender (this is the part where I give you a little responsibility) is a disaster than halfway through, which is what I experienced with Patelco. I had to fire them almost 60 days in on a very easy refi that I then closed elsewhere in two weeks. Shame on me for applying blindly without talking to a couple of people who've been through this process with the lender I chose! I never even read a review online.

 

Write a sh!tty Yelp review, tell all your friends how much they suck, and move on to a happier place.

That is what I was thinking. I just wasn't sure if the CFPB did anything with Mortgage brokers especially when it is just about inquiries.

An inquiry is a record of a view of your credit file which you authorized by applying for something. It's a legitimate inquiry.

 

There are almost no inquiry-sensitive lenders... unless your credit profile has bigger reasons for rejection. Yes, there's FNBO, so before anyone replies that they may not give you a CC because you have too many inquiries... there is at least one. Big deal. :D

 

I am also a card-carrying member of People for a Perfect World, but what I've learned in life is to do a pragmatic assessment of when to flash my membership card and when not to. This helps alleviate the risk of an early death from chronic anxiety.

Well I never got around to submitting a complaint to CFPB but yesterday I received a FEDEX overnight priority envelope from Howard Hanna. There was a letter from an executive appologizing for their lack of communication. There was another letter from the local manager that explained again what happened. And lastly there was a letter from the people they use to pull credit reports that if I sent them a letter explaining what happened then they would remove the inquiries. They even provided a letter for me to just sign and send back to them.

 

A lot of people say the BBB is worthless because companies can buy their rating but in this case it sure seems like it is going to pay off.
