Wife got financed at a BUY HERE PAY HERE back in 2009 which only had 12 month terms.. in this time, they switched finance companies and their records within were either delayed, off, or just plain poor. When she was done paying on the vehicle, they had in their records like there was another payment owed, and after doing their research realized it was due to the whole finance company change and eventually sent out her title. During the repair, I noticed this account was listed under "CONSIDERED NEGATIVE" accounts and so I decided to look into it as a result of knowing that she always paid this on time. Anyhow, They originally had listed as follows:

 

30 Day Late in JULY 2010

 

PAID BY CREDITOR in OCT 2010 which was last month of the terms.

 

I disputed with Experian as dates being incorrect, and now they have changed to this:

 

30 DAY LATE JULY 2010, AUGUST 2010

 

60 DAY LATE SEPTEMBER 2010

 

CLOSED OCTOBER 2010

 

The account is noted as PAID IN SETTLEMENT!!

 

At this point in less than 30 days where we pull for mortgage, this is NOT ACCEPTABLE.

 

What would be next step in repair after disputing with BUREAU and they also have no phone number listed... please do assist...

We do not, however, Im sure in their system they will see that they were receiving SAID late payments (if they actually were even late) from the first finance company who insisted we were still sending them the payments. They would then forward the other company the payment. This has to be noted because this was the information that had to be sorted out for them to see that they actually did owe us the title at said point in time instead of another payment. But to answer your question, with it being over 5 years ago and way before we would think we would ever be doing repair, we no longer have those money order receipts. They did, however, at that point and time, make us fax them over back then to clear up what was going on.

I wrote this that I am going to send CMRR today... please let me know if you guys think i should add or take anything out... I anticipate to be sending this out in about 2 hours.. please advise:

We are going to keep this letter short and sweet because the fact that we are still even dealing with this more than five years later is insane. I had a vehicle that was transferred to you while I was financing it and you were the last lender we dealt with. Apparently during the transfer of the account to you, they were still directing me to send payments to them, which they would thereafter send the payments to you. Eventually, this process was changed and then we were directed by you to start sending the payments directly to you. Apparently, you guys chose to report when that payment was received from them, and your system had me missing a payment which was realized at the end of the terms when I was set to receive my title. This was supposedly all cleared up when I got my title, however, it apparently is still being handled poorly by your company. The information being reported on my credit was that this account was PAID BY CREDITOR which was ABSOLUTELY incorrect. I disputed this information with the credit bureaus and you guys in turn updated it to include late payments that did not exist seeing as I was on time with every payment on this account. I will not accept this failure to have your records in order and I refuse to allow it to affect my credit rating at this point in my life, FIVE YEARS LATER, being the only thing reporting as negative on my credit file. I will accept nothing less than you correcting this information AS SOON AS POSSIBLE, and notifying me that this has been taken care of. I STRONGLY advise that you take a look at the notes on this account from that timeframe to see the mistake that was made then and correct the mistake that is being made now. If you have any additional questions, I have included my information at the bottom of this communication, but I expect for this account to be updated as having been ON TIME for every payment, as well as PAID IN FULL! I look forward to your communication and correction of this mess!

I would make this a 623 type letter to force them to investigate this properly so you have recourse. If you do a 623 dispute and they have no records to properly investigate it then they must remove the negative information, which can end up as a complete deletion of the TL.

 

Anyway to get old bank records if you paid that way? Even ATM/bank withdrawal records for the amounts of the payment (if made by cash) might be useful.

I will 2nd this. If I were to receive this letter I would not take it seriously.

 

Remove the short and sweet part, no need to describe the length.

 

Remove the capitalized words, that is not professional.

 

Don't use words like mess at the end. Change that to incorrect data or something to that effect.

Dispute with the CRA's: "This loan was paid in full and on time. There were no late payments or settlement. Because all payments had been made, the company released their lien on the car."

 

When a loan is sold, the old company has to forward your payments for two months. Delays in the forwarding can't be used to consider you late (if old company received payment on time, it was on time). By the end of the 2 months you're supposed to be paying the new company directly.

 

"September, which was the end of the terms..." You paid it off early then?

 

I completely agree with the others, don't send that letter, it needs a total re-write.

Since you're so close to doing a mortgage pull id probably open a bbb dispute / cfpb complaint in addition to any letter you send. That'll get their attention.
