Sending a simple DV letter to Midland Funding and Portfolio Recovery sometime tomorrow.

 

CRs show Midland had the account since 7/2013 and Portfolio had the account since 9/2012.

 

Not sure what will come of these letters, but any advice?

They may send you the minimum needed for verification or they may go away. You need to find out if these are within SOL and be prepared to PIF, if they come after you. The time they've had it doesn't really matter unless it's past the time allowed for reporting.

 

Don't let "simple" be not enough. I suggest posting your letters for advice before mailing.

The letters will be sent cm,rr.

 

They are within SOL, until feb/march 2015.

 

I can PIF, would rather settle for as little as possible for deletion of course.

 

I'm on my phone at the moment, can't show the letter.

 

Basically, it's there info with partial account number showing on experian report.

Stated I pull my report and shows them reporting I owe them money, validate it. And send all mail: my info.

I've been told that you should send the letter on a yellow sheet of paper with your signature in blue ink(even if the signature is typed, it should be blue) , if you can't do that then at least make sure the signature is in blue. Apparently it keeps them from being able to scan the signature onto false letters of agreement and such.

 

Not sure to what extent that's true - but it kind of makes sense. Maybe someone more savvy with computers can shed light on that bit?

If you're comfortable sending it within SOL, it sounds like your taking the proper steps. Make them prove it before ever offering any kind of payment. Have you tried to dispute them with the CRA's yet? I was able to get rid of both of them with DVs but it took a little more effort with portfolio.

I also forgot to mention that you can do the yellow paper thing (no signature) when sending initial disputes to a CRA, but it's not advised to do it with CA letters. Those need to be proper letters in case you need them for court. Most CAs, if any, probably don't have scanners so no need for the theatrics anyway.

A brief and to the point typed letter with no signature is all that is needed. Put the certified mail number in the letter's information block

Letters sent CMRRR. Now we wait and see.

Personally, I believe this is the most important part. Just send the letters. My problem when I went through rebuilding was sitting here all day long and making game plans but not taking action. Now if something pops up I fire out a DV that day. I use the same basic DV every time. Some of the DV's I see people use are ridiculous. Simple and to the point is all you need. CA's don't get intimidated by long drawn out letters with all kinds of law talk and demands.

Get everything CMRR, ask a lot of questions in the letter, make it hard for then to get the info; even if they do respond with a stack of photocopies statements if they didn't send it CMRR... Then you never got it ;) Keep good records

I have a question... What do you do when you have never received any communication from the CA and all you have for an account number is the partial from the CRA (such as 4567****)? Do you just put that in the letter and expect the CA to figure it out?

Yes. They will be able to figure it out because they are reporting it. If not, they need to delete. If they ask for more information don't provide anything.

I just sent out a bunch yesterday and left the spot blank per another users recommendation. I did end it with "Please do not contact me on the phone (home, work, or cell) as it is inconvenient. Please contact me through the mail. All correspondences can be sent to the information below." Then I typed my name and address.

 

I have a question... What do you do when you have never received any communication from the CA and all you have for an account number is the partial from the CRA (such as 4567****)? Do you just put that in the letter and expect the CA to figure it out?

Less is more. The less work you do, the more work they will have to do.

Just received a letter back from Midland. They sent a few copies of the last few statements from Paypal (the OC) and also stated in the letter they have filed to have th CRAs report the TL as disputed. Nothing else. Do I attempt to send a PFD Settlement offer now?
