Question about Midland and N/A's....

HI all! I am looking at my Experian report which is my worst report and for Midland there are two from Midland that say almost nothing...and I also have The CBE Group who are also reporting for one of the Midland accounts...

 

For negatives on Experian I have 5, these 3 and two more one from LVNV that I just disputed obsolete and hopefully that one will drop off. After I get the answer back for that dispute, I wanted to maybe dispute the 2 Midlands?

 

I know that my report shows "customer disputes..." but this had to have been last year when I disputed this.

Midland pulls the same garbage all the time. They send a collection letter with a "statement" and then when you dispute they say it's disputed under the Fair Credit Billing Act, apparently some BS way of trying to avoid validation. Midland does not meet the definition of a "creditor" under the Fair Credit Billing Act and it therefore does not apply.

 

I've been meaning to file a complaint about this with my state's Attorney General and the CFPB since I pulled my last credit report and noticed what they'd done but I haven't gotten around to it yet.

 

Midland, if you're lurking, you're a debt collector. Or do you need a little Federal help to remember that?

Does anyone know how I should proceed?? Also, I noticed that CBE Group that is collecting for Midland has not updated since 2011, does this mean that I will have an easier task of getting this deleted? I just pulled EX and they still have "this item is being investigated" for the LVNV so I need to wait for that to be complete before I proceed with Midland correct?

Thanks for the suggestions. Well I havent DV'd them in over a year or more but they still say that customer disputes on my CR. I dont have anything in terms of evidence either because when I started doing my repair and before I KNEW better, I disputed online.

 

Should I DV them and THEN complain to CFPB? What should I say?

 

Also my results came back from EX regarding my obsolete dispute with LVNV Funding, which states on my CR that it should be coming off in MAY/14 they only updated... ughh

 

Seeing how on the EX (see my original post) Midland is on there as well as a CA collecting for one of those accounts and neither have updated in over a year, I hope those will fall off after dispute easier?

 

These 2 Midlands are my only baddies left on my TU also.

FCRA requires reporting to be accurate.

§ 623. Responsibilities of furnishers of information to consumer reporting agencies
[15 U.S.C. § 1681s-2]
(a) Duty of Furnishers of Information to Provide Accurate Information
(1) Prohibition
(A) Reporting information with actual knowledge of errors. A person shall not
furnish any information relating to a consumer to any consumer reporting
agency if the person knows or has reasonable cause to believe that the
information is inaccurate.
(B) Reporting information after notice and confirmation of errors. A person shall
not furnish information relating to a consumer to any consumer reporting
agency if
(i) the person has been notified by the consumer, at the address specified by
the person for such notices, that specific information is inaccurate; and
(ii) the information is, in fact, inaccurate.
2) Duty to correct and update information. A person who
(A) regularly and in the ordinary course of business furnishes information to one
or more consumer reporting agencies about the person's transactions or experiences
with any consumer; and
(B) has furnished to a consumer reporting agency information that the person
determines is not complete or accurate, shall promptly notify the consumer
reporting agency of that determination and provide to the agency any corrections
to that information, or any additional information, that is necessary to
make the information provided by the person to the agency complete and
accurate, and shall not thereafter furnish to the agency any of the information
that remains not complete or accurate.
