Hello , About 7-1/2 years ago I had a medical emergency with our child and my usuall excellent credit went downhill . Not really caring about anything credit wise for a few years because of prioritys I am now trying to get my things in order . I ran up an aspire card for close to $9000 for meds and other expenses until I couldn't pay on it anymore . My last payment was almost 5 years ago . I found out the debt was sold to Jefferson Capital and the have erroneously reported a payment in 2010 but I never paid them a thing . I have debt validated ( after talking to a lawyer)Jefferson Capital twice with no answer . They sold the account to another law firm last year who I also sent debt validation to and again never heard a response . Well another law firm is now trying to collect and I have debt validated them also . Jefferson Capital continues to report on one of the CRA's . We are just getting on our feet after a few very bad years with our child's illness and are afraid of being sued . Any advice will be appreciated . I live in Pa. I have about $3000 of other smaller medical debts left also

If this account has been sold from JC to a lawfirm, then to another, JC can no longer report this debt. Not to mention it's past the reporting SOL. That's real cute that the "payment" you made puts you within PA SOL again. When you sent these DVL's did you dispute the account at the same time with the CRA? If not, send another DVL to JC certified, dispute once they signed for your LTR. It would be in their best interest to not respond to the CRA dispute, as

 

#1 This debt can no longer be reported

#2 They cannot verify unless they can validate this debt.

 

These are FDCPA and FCRA violations adding up,

 

§ 807. False or misleading representations [15 USC 1692e]

2) The false representation of --

(A) the character, amount, or legal status of any debt; or

 

(8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.

 

JC knows the 2010 payment is false, and yet they are selling this as a "fresh" and collectable debt.

When is the last time you made any payment to any of the accounts you're concerned about?

 

Not only do you have the FCRA, and FDCPA helping you, you also have PA Fair Credit Ext Uniformity Act in your corner.

 

Is JC reporting as a collection or as something else? Have you disputed this "payment" and the rest of the tradeline with the CRAs?

 

I racked up quite a bit of medical bills (which is how I ended up on CB) when my Daughter had some medical issues as well. I also ignored my issues for many moons as the unopened letters piled up in a box in the corner. You're taking a HUGE first step in tackling this..... I applaud you. Before you dispute anything else, or write a letter - come up with a game plan. Credit repair is a chess game - you have to know your next 2 or 3 moves.

The last payment I made on the Aspire Card was almost 5 years ago . Jefferson Capital is stating ( just found this out) that I paid them a single payment around 3-1/2 years ago . I have never paid them a cent but it shows on my credit report .I have a few other minor bills that I should be able to clear up ( mostly medical that my insurance didn't cover ) but the Jeff Cap is my biggest worry . I don't know whether they sold the account or had other CA 's representing them as Jeff Cap was always mentioned by the other firms . I have DV 'd both CA (reps for Jeff cap ) with no response from either . Only Jeff Cap is reporting this on my credit report as a negative account but not in collections whatever that means Edited by Nordlander

what have you done so far to attack this?

Jen ,I live in Pa. I sent off 3 packages this week to the 3 CRA's with my DV,s to Jeff Cap and the 2 other firms either representing Jeff Cap (or that bought the debt from them) that I have DV'd with zero response in the last couple of years. All my mail receipts were also included (copies of course) I don't know what comes next ;nothing bad I hope

Jeff Cap sent me a letter stating : Dear........

Jefferson Capital systems is the servicer of the above referenced account and we are in receipt of your recent correspondence. Based on your stated dispute we have ceased collection of this account until such time as verification is provided to you. In addition as a courtesy we have requested that the consumer reporting agencies delete the account from your credit file. Ect., Ect. .................whatever all this means we will see what happens next

Jeff Cap also stated this is a time barred debt. Because of the age of the debt they said they will not bring any kind of legal proceeding against me such as a lawsuit or arbitration, to collect on the debt . Further they also stated in the letter that if they transfer the debt or reassign it to a new owner , the successor or new owner will be required in writing to do the same .
This letter came from a letter I sent a couple of weeks ago to Jeff Cap . I don't think this was a result of all the documented paperwork I sent to the CRA's a few days ago but who knows . Should I forward this letter to the CRA's ?

Well the Jeff Cap tradeline has been deleted from all three CRA's . Only Experian is reporting the original Aspire account . Does anyone have any ideas how to proceed in how to get this deleted ?

My last payment was almost 5 years ago

 

 

the DOFD starts 30 days after you miss a payment, and are never again current leading to a charge off 180 days later;

 

what is the DOFD listed on your credit reports. ?

 

the OC should be reporting $0 balance, sold or transferred to another lender

 

and it shouldn't be affecting your score that much 5 years later.
