You have to check the local regulations.

 

Since this is a contractual dispute, you usually can file based on 1) where the contrat is signed 2) where it's broken 3) where it's supposed to be executed 4) where the defendant resided or worked when signing the contract

 

If you're gonna do this, ask for deletion and damages. Be prepared to demonstrate the damages (how much it costs to repair your credit, how much time you spent on it, your hourly rates). There are monetary caps.

This is what I found on the civil court website for the city where the contract was signed. This is the city where the OC is located. However, the CA is located 4 hours away in a different parish altogether. It's my understanding that I will have to file in the CA's city because they will be the defendant. Let me know if that's how you interpret it.

 

Who may be sued in this City Court?

 

The person or company being sued may be an individual, a sole proprietor, a partnership, a corporation or an incorporated association such as a club or association. The person being sued is called “defendant.” In some cases there may be more than one defendant. It is important that you properly identify and sue the person or company who has caused you damage or injury.

For your suit to be filed in the proper “venue,” the following general guidelines apply:

  1. If the defendant is an individual, his “domicile” (usually synonymous with “residence”) should be within the ***** Parish, LA).
  2. If the defendant is a corporation, its “registered office” should be located within the ****** Parish, LA (for this information, check with the Louisiana Secretary of State, Corporation Division, phone 225-925-4704.)
  3. If the defendant is an incorporated association, its principle business establishment should be located within ***** Parish, LA

None of the points apply to the CA. Thanks again!!

Ok, update time!!

And now for the 2nd best newS:

 

I have been sharing all of the success I have had repairing mine and others (mostly family members and co-workers) credit issues with my realtor. Just 6 months ago I was not even eligible for a FHA loan. Shortly after submitting an offer on our home I helped my realtor triage her own reports. We spent hours going over them while I explained her options. She in turn told the brokers that she works for about the great work I was doing. Well, now they want to HIRE ME!!! They are going to pay for me to get my real estate license, sponsor me during the process, and even set me up with a desk in their office building. And the best part is they want me to "assist clients with credit problems" so they can improve scores and get financing. Seriously? I love credit repair!! In addition, I will also be helping out part time with the client load when they get busy, or go on vacation. This is like a dream come true. The agent will pay me a precentage of their closing for every client that I help. We still need to iron out the details but surely this has got to be a win/win. Plus I end up with a real estate license that is all mine, for free! Of course I will keep my FT job as a nurse and do this on the side. But, if it goes well I can hopefully cut back my hours. Maybe even, dare I say it, switch to a day position..GASP..

So the last few days have been rough.. STILL haven't closed on the new house. Something about the title has the seller's 15 y/o son's name on it. A tutor has to sign off on the paperwork and a judge has to sign it too. We knew nothing about this until this past Thursday. We were going to close on Monday but that's not going to happen at this point. Doesn't seem like anything major but it's definitely been a killjoy on the whole process. Then the sellers realtor asked us if we wanted to put the utilities in our name or she is going to have them disconnected. We are assuming the realtor had the utilities turned on in her name in order to sell the house. Well that's not going to happen! And we have since demanded the utilities be left on for final walk through. We thought we were going to painting our new house this weekend. Now we're are not sure we will even close by the weekend. Ughh!! Trying not to get depressed. I know things could be soooo much worse.

 

Praying we can close on Friday and move on with the next chapter of our lives!!!

 

P.S. As soon as I get settled into my new house I have a small claims form all filled out and ready to go for a certain CA that will not go away!! They are not gonna like me when I get through with them!

Keep the inevitable delays and setbacks in perspective. They're a b1tch and a half right now, but in 30 days or less they'll be a distant memory. Hang in there.

Immediately applied for Lowe's online--- $300 CL---called recon---$5000 :dance:

 

Barlays Mastercard- 7-10 day message, will call UW tomorrow.

 

Going to refinance my car tomorrow at my credit union. Surely I'm deserving of a rate better than 11.5% with a 100 point score increase!! Cap One was great when I needed them, but it's time to move on.
