This is the first dunning letter that I have received in a long time. I guess my collection score is through the roof now.

 

Here is what the letter says:

Current Owner: Galaxy International Purchasing, LLC

OC: MCB / GC Acquisitions

 

Dear Futurehomeowner? (I am going to shorten the letter a little by leaving out a few unnecessary words)

The above account has been assigned to Northland Group for collection. Your balance ins $1086, because of the interest your balance day to day may be different. If you pay the above we will notify you if there is still a balance prior to depositing your check,

 

Galaxy is going to reduce your balance in a settlement. If you pay $326.04 your account will be resolved.

 

Unless you notify us within 30 days of this notice we assume the debt is valid. If you notify us that you dispute the balance we will obtain verification or obtain a copy of the judgment and mail a copy to you as verification.

 

This is an attempt to collect a debt and any information obtained will be used for that purpose. This communication is sent to you by Northland Group Inc, a debt collector and member of ACA international.

This collection agency is licensed by the Minnesota Dept of Commerce.

 

I guess I am trying to decide if I should send a DV or a FOAD. The letter does not include any lines that say it is outside of the reporting time and won't be reported to credit. It also does not say they won't sue.

I have no idea who the current owner nor the OC are. I am in PA and our SOL is 4 years and I am almost 100% certain that I have nothing hiding within the 4 years. Does anyone know who either of those 2 are? If this is the 2nd or 3rd place that has had this I would assume this is a super old debt and this is a JDB? Is there a violation by them not listing this is an old debt or anything like that?

I would start out and ask for the name of origional creditor and the address. Galaxy has to provide the name, address, amount and account number of the current owner or a copy of a judgment if applicable. If you are buying a house, this debt will probably have to be paid off. I don't see any violations on the CAs part. If phone calls by the CA are going to be a hassle, just say 'don't call me at any time.'

If this is within the 7.5 years reporting time I would assume it needed paid for a house but I don't know that it is. There is nothing on my credit currently that reflects anything like this.

 

I also thought that letters that were outside of SOL had to state that on the letter and same if it is outside the reporting time. Or is that a line that they put on dunnings just as an FYI.

The letter says the OC is MCB / GC Acquisitions...but this doesn't really sound like an OC either, more like a JDB. I agree with Sandscrit, find out who the OC really is, and proceed from there.

I have been doing some searching and I think this is a capital one debt as it seems like MCB/GC purchased a lot of old capital one debt. If it is really a capital one debt then I couldn't tell you how old it is. I have been married 5 years and it had to be many years before that.

people including mods are saying there is no point to a DV since you know its your debt. Just pay it an be done with it. I am so thankful that I found this forum before I found that one. 1 wrong click and I wouldn't be anywhere near where I am today on the rebuild.

Just got the exact same thing. 14 year old HSBC card is the OC is my guess. In the exact same position too, months from mortgage app. They must be buying data from credco.

 

Maybe we need a class action.

Does your letter have the wording about it being outside of reporting limits and we won't sue you?

I've done some research and I am piecing together that this a debt that was already paid to another CA plus it was CO in 2007. So this should put it well outside of the SOL. Is there a special FOAD for an open attempt at committing fraud on me?

Cap One is probably the new owner and they are trying to play catch up on old and out of statute debt.

This will all go away if you can prove the account was settled; otherwise, it can get messy for you really fast. This is why it is important to keep good records of any interactions between the OC or a CA about debt on a long term basis

This is what Galaxy is trying to collect on. I'm still in the air if I should send them anything at all.
