re-aged GA State Tax Lien-PLEASE Help!

I have sort of a unique situation with 2 state tax liens that I have not been able to find a solution for anywhere on the boards. I am a newbie and would very much like some help with a plan of action for getting these off of my credit reports. Here is the briefest possible explanation of my situation:

 

Tax Lien #1:

Was filed in July of 2007, paid immediately, and released in 2007.

Problem: This was re aged and now the date released says 2010. Unfortunately, I have nothing to support that it was paid in 2007.

It is reporting on EX and EQ only

Also, each CRA shows a different court case# for the same tax lien. This seems weird to me.

 

Tax Lien #2:

Was filed in July 2008, paid immediately, and released in 2008.

Problem: same as tax lien #1- This was re aged and now release date says 2010. Again, nothing to support.

It is reporting on all 3 CRAs with all showing different case #s.

 

When I searched public records on the state database and PACER neither one showed up. Even though they are released, because they have been re aged they are hurting my score. If not for the re aging they would be due to fall off in the next couple of years.

 

Does anyone have any helpful advice as to how I should go about getting these removed from mine and my husband's CRs? By the way, what did they put the lien on? We didn't own any property at that time.

I used to live in GA and you have some options.

 

First: they put the lien on your social security number and credit report. GA is infamous for doing this with no warning.

 

The state of GA should be able to give you a release of lien and a statement of when the account was paid. You can send that to the CRAs and dispute it off that way. Make sure if you have changed addresses since those liens were placed that you have those old addresses off your credit report FIRST. If you haven't moved and still live in the same place that is not needed.

A couple of questions though:

 

1. Would going down to the courthouse "wake a sleeping giant"?

2. Even if I get a statement from them saying that the lien was paid and released couldn't the CRA still say that even though it's paid and released it can still show on the CR for 7 years? Would I be verifying my lien by giving documentation?

A third party has reported this to the CRA's, not the state of Georgia. You need to dispute this with the CRA's, but at the same time, get your Innovis and Lexis-Nexis reports and see if it's on there. That's the likeliest source of the outdated info being re-aged.

 

I would use something similar to Why Chat's dispute for judgments. Check the tabs up at the top of the page for links to Why Chat's site. Just take the general idea of the dispute letter and rewrite it to fit your situation.

UPDATE!!!!

 

I did find both liens on the GSCCCA lien index. They are both stamped that they were paid, satisfied, and cancelled on the 24th of June 2010. How can that be? I was physically not there to pay that on that day. I remember specifically paying those immediately because it scared me half to death but unfortunately I do not have the cancelled check to prove it. I did a search of my bank statements but couldn't find it. I'll look again.

 

Do they have to release the lien once you pay it or can they release at their "leisure"? Also, is released the same as cancelled?

 

This is so weird. I don't even know how to begin to get rid of these things. This is not right. If it weren't for these liens and one 30 day late on a cc I would have perfect credit (well, once I get my balances down, ha).

 

Any advice? Please help!!
