Background:

Three of my CCs were CO after I was laid off. I am working to rehabilitate my credit with a slim savings account. After successfully applying for a secured CC, I awakened the Cap1/Northland mutuant by giving the CRAs some positive activity and my current mailing address. Naturally, Northland sent me settlement offer a few days ago.

 

Why this is an issue:

Thanks to the contributors here, I know Cap1 keeps great records and dilligently wrecks my CR on a monthly basis. Therefore, getting this "baddie" off my CR is on the to-do list. However, I can't afford Northland's settlement offer.

 

Where I could use your advice:

Should I '1-2' Northland/CRAs before requesting a lower settlement offer or would doing so push this settlement offer, and any potential lower offer, off the cliff of reality?

 

The economics:

-CO Balance: $2,500

-Settlement Offer: $1,250

-What I can afford to settle: $600-$800

 

Thank you in advance. This board is the definition of community in the 21st century. Tunnel vision is blinding and I am prone to it. If there are better plans of action I sincerely hope you'll share them.

Thank you and great question, I should have addressed it in my post. It is well within the SOL, not expiring for 4 years.

It is truly surprising to see that no one has any advice on this matter. If I don't hear anything by EOD I will just DV them. Thanks nonetheless.

I've been gone from the boards here for awhile, just recently signing up again. I don't think that a lack of response has anything to do with your post not being sexy enough. There has been a lot of bad weather around the country, and people are also volunteering their time. I'd wait for an expert to chime in here, but if you are withing SOL be very careful what you do unless you are prepared to be sued.

Hey Tabasco, thanks for reviewing the post. In line with what you've brought up - another question is whether Cap1's monthly COs (for the foreseeable future) are hurting me so much so that DV'ing Northland is worth the risk. What to do you think?

Well, I had some bad things going on with our reports that there was no way we could pay. My solution was to just not do anything that would hit my credit report (aside from the fact that we had one good major credit card reporting every month). The reason your post caught my eye is that I was wondering if I changed my address to my current one if it would catch the attention of anybody. Now everything has dropped off DH's report EXCEPT there is a default judgement on there! The address is across the state in a town we've never been to and we were never served, but it could actually belong to us. There is a person living at the address with DH's EXACT name except for middle initial. I am deathly afraid of waking it up and causing a bank freeze or a garnishment. So... I might not be the best one to answer your question :D

But it seem like you've already woke them up, and I've read enough to know if you go to court fully armed and documenting your paper trail you may even get it dismissed. The OC and the CA shouldn't both be reporting anyway, I don't think. So, yes, I think you should DV in the required time period because they may not have enough to document. I know you don't want to ignore it. That being said... hopefully someone more experienced than I can help you out.

Well the DV letter went out last week. I will keep everyone appraised as developments come through. Following up on my successful application for a secured CC, I was approved for another secured card this week from.... drumroll please..... Cap1. Should I open it?

 

A. They are the CC company I just DV'ed, why would they approve my application (which I did just out of curiosity?)

 

B. I looked at their website and they require the first deposit be made by putting in my bank account # and routing number. I am just making a potential garnishment action that much easier?
