Can Previous Employer Do This?

Lender sent for VOE for past two jobs. The previous employer puts "termination due to substandard job performance" on the request form. Wha? It's not a damn job interview. Just did he actually work there and did he make x amount of money.

Usually they will just say he was employees between x and y dates and refrain from commentary if they don't have a positive recommendation to make. Mostly to avoid possible issues/lawsuits

 

Laws vary by state on this however

Take a copy of the notice, call a lawyer!!

 

No need to call a lawyer because it isn't illegal. If the reason for the termination was accurate they can say it. If it is not true then it is libel (because it is written) but the OP has to prove actual DAMAGES in order to prevail in a lawsuit. So far there aren't any damages that they have suffered due to the disclosure.

A former mentor of mine always said "never attribute to malevolence what can be attributed to stupidity." You know what the purpose of the form was but the chances are pretty darn good that who ever they turfed it to in the HR department assumed without reading it that it was a verification of employment for job purposes and simply filled it out that way. While it stinks that they did disclose the reason for your termination, it isn't illegal if it is true.
