Next step in dispute of old Orchard acct?

Looking for input on this account.

 

 

HSBC Bank account (formerly an old Orchard card) is reporting on EX & TU as closed/charge off. Account opening date on EX & TU is May 2006.

 

I disputed the HSBC entry as obsolete (my records indicate DOFD was September 2006, so should drop off September 2013). I disputed both EX & TU as obsolete in hopes this would fall off early.

 

Transunion dispute results are back and they updated as follows:

 

Account Sale Info: ACCOUNT SOLD TO PORTFOLIO RECOVRY Remarks: ACCT INFO DISPUTED BY CONSUMR; PURCHASED BY ANOTHER LENDER; TRANSFERRED TO ANOTHER OFFICE Estimated month and year that this item will be removed: 07/2014

 

I'm still awaiting EX's response to my dispute as obsolete.

 

My question is, assuming EX responds in the same way, what should my next step be? Thanks in advance for suggestions.H

 

 

 

 

 

 

Side note: Portfolio Recovery was reporting on all 3 for this account, but after dispute (they were reporting payments) it is off EX & TU and I expect it off of EQ any day now per their response.

Have disputed old addresses so that now only 2 remain: my current address and my previous address (reported by HSBC and none of the 3 CRAs will delete it - been down that road repeatedly).

 

I dispute only CMRRR (except for HIPAA in which case I follow Whychat's instruction to CM).

 

I previously sent a DV to HSBC and they validated (this has been a few years ago as this is a fairly old account).

 

In looking through old bank statements, I was able to find the first late/missed payment in September 2006.

 

Is there something else I should send to HSBC demanding they supply proof of account history to validate the dates they are reporting?

Maybe I shouldn't have used the term DV. Years ago before I understood credit repair, I sent HSBC a letter saying "please prove I owe what you say I do" and they sent back a letter with account dates, etc. Since then I've done a lot of credit repair and made huge strides thanks to this board. I just wasn't sure how to handle an OC reporting dates that I don't believe are correct (particularly when correct dates could result in this item being removed due to age).

 

I've never done a 623 so I'll read up on that. Thanks.

They can't report anything older than 7 years (read the FCRA) so the HSBC entry will expire in the allotted time. Portfolio is a new debtor, so they can report. Apparently they bought this a year after it was charged off, so they can report until the date you got, which is 2014, which may or may not be accurate. Again, read the FCRA. The only shot you have at Port-A-Potty is if the debt is beyond the SOL for collections. Is it?

Thanks Legal - Portfolio was deleted due to a different reporting violation (as they were reporting payments that were never made - they sent me a 'we didn't report this, but we're taking it off all 3 bureaus anyway...' letter).

 

The debt is outside SOL for me.

 

The dates on the original HSBC account are what I'm questioning. Based on HSBC's response to my attempt at an early obsolete dispute, the tradeline will report through 7/2014. This would indicate that they believe DOFD is in 2007, and I believe it was in 2006. I understand the 180 days + 7 years reporting limits per the FCRA, but I was trying to determine if there is any way to get HSBC to prove that the dates they are reporting are accurate, or if not, to correct the reporting dates with the CRAs.


I know it may seem a small thing to be looking at this over just a few months difference, but this is one of only two remaining old negs on my CRs so I'd love to get it taken care of earlier than next year if possible.

PRA cannot report it any longer than HSBC can, they must go from the original DOFD. You have a violation of the FCRA should PRA continue to report it past Sept 2013.

I took this angle as well. I wrote them a letter with a copy of my equifax report that showed they were reporting payments and told them to remove the TL or talk to my lawyer. They removed it pretty quickly.
