Wish I had found WhyChat's credit confusion earlier

Ok Why Chat I had to take a break, this is so over my head.

 

So I send this letter to the CA.

 

Send the reporting CA this:( 2 letters, one for Ex and one for Eq in the same certified mail envelope)

This letter is being sent to you in response to your recent verification of a medical account on my (name of CRA) report.

This is not a refusal to pay, but a notice that your claim is disputed.

Please attach copies of:
Agreement with your client that grants you the authority to collect on this alleged debt,or proof of acquisition by purchase or assignment. and authorization under subtitle D of the ARRA ,SEC. 13401. APPLICATION OF SECURITY PROVISIONS AND PENALTIES TO BUSINESS ASSOCIATES OF COVERED ENTITIES;and SEC. 13407(1) BREACH OF SECURITY.— Please note that enforcement of penalties against you is covered under the penalty rules of the Omnibus Final Rule effective 09/23/2013.

Please also be advised that this letter is not only a formal dispute, but a request that you cease and desist any and all collection activities, including reporting of; or verifying of this account on my credit reports.

Your receipt of this letter will be considered as having granted consent to the taping of any and all telephone calls to me at my home or business by you or your agents or assigns

I require compliance with the terms and conditions of this letter within 30 days. or a complete withdrawal, in writing, of any claim.
In the event of noncompliance, I reserve the right to file charges and/or complaints with the OCR on your HIPAA violations and appropriate County, State & Federal authorities ,the BBB and State Bar associations for violations of the FDCPA, FCRA, and Federal and State statutes on fraudulent extortion and illegal collection activities on an account that has been paid in full and subject to the provisions of Public Law 104-191 ("HIPAA") since there can be no permissible business purpose in divulging protected health information to anyone on an account once there is no longer any payment due.

In addition the new Omnibus Final Rule states:when patients pay out of pocket in full, they can instruct their provider to refrain from sharing information.This account was paid in full to ( name of OC)on 1/29/2014 and included this letter of instruction.

I also hereby reserve my right to take private civil action against you to recover damages.

I have already did these steps

 

1. already paid with hippa insert a

2. cashier check cashed and I have a copy of deposited check

3. I sent the follow up letter to the CRA after receiving green card back.

4. I sent a copy of the follow up letter to the OC legal department with the cover letter.

5. The CRA verified still unpaid on credit report.

 

So do I send the letter above?

Sorry, I lost track of your case. Please summarize.

 

Is it reporting as paid or unpaid on the Eq and Ex reports.?

 

Did the reporting CHANGE after the payment to the OC??

 

IF the reporting did NOT change, then yes, send the medical DV to the reporting CA.

 

If the reporting DID change to a paid collection , then do NOT send that letter, send this one:

What caused you to pay the OC with the HIPAA letter insert "a"?? What documentation did you have of a current relationship?? If, of course the reporting changed to "paid" that is sufficient proof.

reporting on Experian only, due to fall off in April

reporting on Experian and equifax

 

Is it reporting as paid or unpaid on the Eq and Ex reports.?All 3 are reporting as unpaid

 

Did the reporting CHANGE after the payment to the OC??both Experian and Equifax verified and sent me the updated credit reports in the mail.

What caused you to pay the OC with the HIPAA letter insert "a"??ARS sent a validation with the old acct #, correct date and amt . You said this is proof of a current relationship.(no other info given in the validation letter) What documentation did you have of a current relationship??I did call the OC and they told me ARS had the account If, of course the reporting changed to "paid" that is sufficient proof.it is still unpaid

 

Equidata sent more info for validation insurance info and Dr name. So I paid the 44.00

I have not paid the 75.00 waiting for it to fall off.

 

Why chat I am house hunting now I will not be able to close unless these are removed or listed as paid. I know what will happen if they list as paid but I am getting pressure from the mortgage company.

 

So I will send the letter from post # 51 to the CA correct?
