Portfolio Recovery - next tactic?

I have a collection of $440 from Portfolio Recovery on all three CRAs. I think this is an old Orchard card. DOFD should be September 2006 (by my records). In an attempt to resolve, I recently sent Portfolio a DV on 5/1 (CMRRR received 5/6). I subsequently sent them a 'estoppel by silence/restated demand for validation' with a 15 day expectation of response and received nothing in return (mailed on 6/7).

 

I'm not sure what's next since they seem to be ignoring me completely.

 

Should I dispute with CRAs, then request method of validation followed by an ITS? Should I try a BBB complaint?

 

Appreciate any advice from those who've had luck with this one. I've read a lot of posts on Portfolio and haven't found much that parallels my situation.

how are they reporting? do you see if on their account on your CR's if they are reporting payments that you never actually made to them? I just got them deleted from all 3 CRA's for this through the BBB, it is a violation of the law and they even got caught trying to cover it up in front of the BBB.....check your EX and EQ and see if you see fake payments you never made.

I second what newearth just said. I did the same thing. My Experian report showed the payments they were reporting and that is what I pounded them on via the BBB....They caved and said they were deleting but swore up and down they did nothing wrong....Still waiting for it to drop off Equifax. It has dropped off TU and EX...

Mine fell off EX immediately, like the next morning after they sent the universal data form. I waited a week for TU and EQ and got tired of waiting so I disputed. TU deleted about a day after that and EQ JUST deleted 2 days ago :/ Took them almost 2 weeks, even faxed a copy of the letter & UDF from PRA. Anyway, they are finally gone from all 3.

They are reporting payments as $NaN (on myfico.com reports) and showing opened in 10/2008, last reported 6/2013, High balance of $440. They are only appearing on TU & EX now (were on all 3) and are showing as "Disputed by consumer; meets FCRA" in the remarks. This is probably from a previous unsuccessful dispute.

 

Should be out of SOL for me based on my review of old bank statements.

it looks like you are getting info from MPM? The fake payments don't show up on there for some reason some times. You would need to get direct copies from the CRA's. Have you disputed anything recently? If you have a file number from them, or a file # from a recent credit report directly from them, you can access your direct CR by going to the online dispute page, act like you're going to dispute something but don't. it will give you access to the direct CR and you can see/print out/print screen etc. the fake payments as proof.

John & newearth, thanks for the direction. Went to the EX site and found that they are in fact reporting payments that never happened (see below). If I had actually made all the payments they've recorded, the balance would be zero anyway!

 

Any particular law or statute I should refer to in my complaint regarding reporting of false payments?

 

Off I go to the BBB.... thanks again - will update with outcome.

Update: Received a response to the BBB from PR stating that while they "never reported any payments to any credit reporting agency", they would close their file on me and have all reporting of my account removed from all three CRAs (EX,EQ,TU). They have since done exactly that - it is gone from all three CRs. BBB worked like a charm on this one. Thanks for the help and support on this one everyone!!!

 

Now I'm off to tackle the OC (HSBC originally Orchard). :wave:

Sweet. Do you mind if i PM you for an idea or direction of how to start formatting a letter as such? I have two Portfolio accounts and only disputed one with CRA lately. Can i go directly to BBB based on the fact that I did the one dispute at least.. both accounts are showing the imaginary payments on EQ and EX. Want to take the quickest route to rid of them however i have never done a BBB complaint either. Please advise...
