So far this is based on my experience and what I have read here. Add your own experiences as we go along. I want to know which ones will/can validate. Which ones can't validate. Which ones play dirty and reinsert or anything of that nature.

 

- AFNI will fold like a house of cards if you are aggressive with them from the start. I emailed them (google executive offices emails) and I submitted the same text on their online contact form. They emailed me back within a day. The first time they said no. The second time (same day. Different rep?) they said "deleting with all 3 bureaus". I checked and they did and I got a letter in the mail yesterday confirming.

 

- IC Systems can rarely validate because they are generally 4th or 5th in line when they acquire the debt.

 

- LVNV/Sherman will also fold but it may take a little more work and possibly an ITS (with action behind it). I just got one of my collections with them removed from EX from an online dispute so I guess they didn't validate. Convergent Outsourcing will fold like a house of cards. Much like IC Systems they are usually 4th or 5th in line to possess an account and have no documentation.

 

Portfolio Recovery can't and WON'T validate. Right now I am at the point of hiring a lawyer and suing for the violations.

You should. Make some money to pay for all this hard work. I need it just for printer ink and postage.

TEK-COLLECT folded immediately for us. They were the first (and only) CA in line on a medical debt, but I believe they couldn't verify the debt because the OC went out of business 2 years ago, so they could be a YMMV. At the very least they knew they were had and played nicely.

Is CCS easy to get to cooperate or no?

Not sure how to answer - I guess best way to say it is, usually when DV'd they respond with deletion and closed to further collections. So I guess that is cooperation lol

I really think though hearing that maybe there is hope with some of them is good. Or, like you said, "no way" might be their answer 9 times out of 10. Just gives people direction. I have googled so many of these so many times just looking for personal experiences and what worked.

Midland and LVNV should be left out of this thread IMO. They are such a YMMV.

 

 

I tend to agree & results are going to vary based on in SOL or out. They are both also known for suing more than any other JDB. I would advise proceeding with caution if within SOL with either of these 2. You have to be careful when poking a big dog with a stick.

I was wondering, what would they do if you call them everyday and make them spend lots of hours on the phone with you. Will the managers finally decide they're spending way too much of their employees hours on it and just settle and delete? I'm asking because few days ago I called LVND and the supervisor seemed a little pissed that I've called them. He basically said why do you keep calling if you're not willing to pay( of course I'd pay if they delete).

I would say it depends if your in or out of SOL. If in and your keeping them on the phone hours a day they'll just file a lawsuit to get rid of you, if out I guess you have nothing to lose by trying.

 

Although it does depend on how much you owe them and how much your time is worth. If you don't owe them a whole lot and your taking hours out of each day to spend on the phone with them it might end up costing you more than say a 40-50% settlement would.

I am new to all of this and reading over the laws has my head spinning. My question is it appears that the laws state that validation can only occur within the first 30 days of new CA obtaining account, am I reading/interpreting that right? I pulled credit report and see that I have a CA that I honestly never received any communication on. Actually 2, one that is like 4 years old and one from the beginning of this year. The one from this year listed as medical its actually a dental bill. I appreciate any help.

Post this as a new topic and it will get a lot more replies. I promise :) Depends on your state with the 30 day thing. However, you can dispute a debt at any time I think it just can't go on your report if you get to it in that 30 day time frame. If you never got a letter from the CA's on your report, that is a violation. You need to send them debt validation letters. There are several examples in the "Letter Samples" section here. They need to show you PROOF that they contacted you. There is a difference between debt "verification" (basically stating that yes, you do have a debt) and "validation" (proving to you that you do indeed have a relationship with these people). The one you have from this year is going to be the tougher of the two and medical collections are treated differently than regular collections as far as how you dispute. Asset acceptance gives you bs letters saying they don't know what you're talking about then finally fell off

 

Enhanced recovery easy as pie

 

IC systems just updated yet didn't respond yet

It All depends how you dispute.

 

I've seen ALOT of DV's answered with a summons instead of validation.

 

Don't use a std Boilerplate FDCPA DV when dealing with a JDB, all they have to supply is the OC name and Amount owed.

 

use the CFPB's or one of mine.
