Midland Collections Lawyer, How Should I Pay Him? How Do I Protect Myself?

Greetings,

I have a 6 year old T-Mobile Bill for 1100$ in collections. It falls off in a year but I am going to pay it anyway because I owe it, and because I will be shopping for a mortgage in a year or two. The lawyer has been in contact, offered a GREAT deal (300$) and I am going to take it.

How do I proceed? I have seen posts that say do not give him my credit card number. I am not sure why as I doubt he is less trustworthy then the nameless, faceless people who process my transactions online but I won't.

How do I protect myself and make sure it is marked as "Paid In full"?

It will still fall off in a year after the payment right?

Hi, get any agreements with Midland in writing or don't deal with them. You will be subject to capital gains tax on anything over $600.00 so you will get a 1099 C at the end of the year.

It is supposedly only 300$.

You will still be receiving a 1099 C at the end of the year because the difference in what you actually owed vs. what you actually paid is over $600. (i.e. $1100 - $300 = $800 you will be getting the 1099C for $800)

 

I had an active midland collection on my report in june of last year with a balance of over $1500... I was still able to get my mortgage approved at a nice interest rate. If it were me I wouldn't pay them a cent and I'd just let it fall off in a year.

If you are shopping for a mortgage in a year or two, it will fall off by then anyway. I wouldn't deal with Midland with a payment unless you are within SOL and they plan to sue you.

FBCS-inc is handling it now. The first rep from that company left me with the impression that he was an attorney that was about to sue me.

I called the number he gave me today, he was not there and a peer of his offered to handle his work today. She sounded much less like an attorney and more like a collections phone employee. I now don't think there are any attorneys involved in this .... yet.

I read they often sue the year before it falls off your report.

Mortgage people supposedly can see all unpaid debts, even beyond 7 year SOL.

Check your states SOL.. I'm in Texas and it is 4 years.. If they are past your SOL of they TRY to sue you but all you need for your defense is to tell the judge that it's past the states SOL. Midland are scums.. they will lie to you, threaten you with lawsuits etc.. just to get you to pay. I wouldn't trust them as far as I could throw them.

I have seen debts in the thousands be charged off and never was a 1099c issued (or at least received).

 

I would settle for $300, whether I could get them to agree to a PFD or not because I would not want to risk having this pose a problem right before closing, i.e. peace of mind, in case you apply for the mortgage a year from now as opposed to two years.

call T-Mobile and see if they will take payment directly. This just happened to me. it wasn't as old as yours but it worked. I paid T-Mobile directly and Midland is deleting, it's already gone from EX and will be gone from the other two in a day or two.

 

call and ask first, the system will say your account is in collection but hit options to get to a live person. see if you can pay direct. if so they will only take payment in full. if you do it, pay INSIDE A STORE, a real T-Mobile retail store so you get an immediate receipt. You can fax the receipt and a letter requesting deletion to Midland. I have all contact info if you need it. It will be gone from all reports within a month.

Unpaid, It can prevent me from qualifying for a mortgage and can still be seen by all mortgage loan departments after 7 years right?

 

No, if it is not on your reports, then mortage lenders cannot see it. They will pull your reports during pre-approval.
