The lates have to be accurately reported.... but they don't have to be reported at all if the OC doesn't wish to report them.

They are not "required" to report what they don't want to. This is why when an OC says they will delete, the E-OSCAR codes get it off your CR in about a day. It is all the computer...

 

Many choose to be obtuse, however. And they are wrong.

My results from several GW requests:

Success:

GECRB/Amazon: Their response to a GW request regarding a single 30 day late in February 2014: "Thank you for your recent inquiry regarding you Amazon.com Store Card account and the opportunity to be of service with you. Effective the date of this letter, we have submitted a request to the major credit reporting agencies to delete any delinquency that occurred in February 2014. It may take the credit report agencies 30-to 60 days to update your CB file."

 

Mixed results:

Citi Cards: As, a result of a GW request sent to their EO regarding a 30 day late in January 2014 & a 60 day late in February 2014, I had a letter delivered to my online credit cards "Secure Mailbox". The letter states: "Your account has been current for the past year. We're confirming that your account has been in good standing for the past 12 months. During that time, you've kept the account current under the terms of your Card Agreement. We Appreciate it!" The lates were removed from my reports within a week of receiving this letter, however they were re-added the following month. I have started a dispute with the CRA's and sent them a copy of this letter with the dispute. I'll udpate with the result of this dispute. The ironic thing is, I was late, and don't dispute that, but curious as to why CitiBank would re-add those lates after removing them. (The Bold in this section was the way their letter was worded, that wasn't my doing.)

 

Denials:

Regions Bank: a GW letter sent to their EO regarding a 30 day late in January 2011 resulted in a phone call from an Area manager in the area my account originated in, however she stated they were unable to remove the late notations as they were reporting correctly. She was very nice and friendly, albeit not cooperative.

 

Harvesters Federal Credit Union: a GW letter sent to them regarding a 30 day late in Jan 2014 & 60 day in Feb 2014 (I paid the account off in full in March 2014, resulted in a letter that stated: "Because we take pride in personal service we have carefully examined your request for a GW adjustment to imrpove your credit rating. After a careful review of Harvesters Credit Reporting Policy and the reporting requirements required by federal law, Harvesters is not able to remove the late notations from your credit file. We appreciate your efforts in trying to improve you credit." The thing that makes me most curious about this is on Experian they report this account as "Paid, was 90 days late" when Experian, nor either of the other 2 major CRA's show any 90 day lates. The only lates I had with them was the aforementioned Jan & Feb 2014 lates.

 

RTG/Rooms To Go/Green Sky Trade Credit LLC: A GW letter requesting they remove a 30 day late from Jan 2014 resulted in this response: "GreenSky has a responsiblity to adhere to the requirements fo the FCRA. GreenSky takes this responsibility seriously. Our records indicate that your RTG account serviced by GreenSky, has always been reported accruately to the credit reporting agency. Since our records indicate your account has been reported correctly to the CRA's we are unable to make any udpates or modficiations to the way your account has been reported to the CRA's."

 

Granite State Management and Resources (Student Loans): A GW request resulted in a follow-up call from someone at their executive center. He stated he did a review of the my account, which resulted in one late being removed but the other 2 remained, he took off the most recent (December 2011 - as he stated they had received a deferment request from me that month but he couldnt do anything witht he other two lates from October & November 2011).

One thing that can be shared is that they *can* change a 30,60, etc to a "ND" (no data reported). That leaves the TL "accurate" while simultaneously "deleting" the lates.

 

I can attest to this. On pulling my report today, my 10 potentially negative TLs are now 5 potentially negative TLs. Goods went from 19 to 22. Lowes looks to have been deleted entirely (along with someone else, I can't quite figure out who yet).

 

On the TLs that switched from negative to positive, the lates switched to No Data.
