I know Capital One has taken over the credit for HSBC & Orchard bank but I'm a bit confused right now.

 

I have some OLD accounts from HSBC & Orchard that charged off at one time. One of them was sold to Sherman

 

Today I received a letter from Capital One regarding an important notice in change of terms along with a Platinum MasterCard® Guide to benefits.

 

Anyone know why I would get this for a closed account?

you don't have any Crap one accounts reporting still?

 

send a facta letter ( ID theft ) to Cap one asking what account this refers to, as you have no accounts with Capital one, and the terms and agreements cannot be changed on a closed account.

 

 

send it to their Fraud dept. address.

 

Dear Capital one Bank

 

I've recieved a copy of new terms and agreements regarding an account with your bank.

 

However, as I don't have any open or current accounts with Capital One Bank, I'm concerned that this may be an indication of ID theft.

 

please provide the following infrormation that is statutorily required under FACTA rules

 

the name an addresses associated with the account

 

The account # that are affected by these new terms

 

please provide the date the account was opened with capital one bank,

 

the last 4 digits of the social security number associated with the account

 

terms and agreements cannot be revised on closed accounts pursuant to the Card Act of 2009.

 

 

( your name, address DL #, last 4 digits of SS# and a utility bill showing residency at your address )

I got this same letter yesterday regarding an Orchard Bank card that I closed March of last year (I think right before Cap1 took them over). I think I got the letter due to some issues with there systems since the account still shows as open on some of my reports. I actually took the oppurtanity to email the Cap1 exec office asking if they want to reopen it, get rid of the annual fee and increase the credit line so I'll see how that goes.

 

It is odd they would send this for a charged off account, but its more likely they just sent it automatically to every account that came over in the conversion and not due to any kind of ID theft. My letter included the last 4 digits of the card so if you still know that you should be able to match it up.

My case isn't the same, but my account charged off with HSBC in January 2008 and they sold it to a company that has yet to contact me or report it. Anyway, Capital One acquired the charged-off and sold account info during their acquisition of HSBC consumer portfolio. Now, Capital One is reporting in place of HSBC as a charge off/sold. Can they do that even after HSBC sold off their rights to the account years ago?

I got one as well...called the EO to find out and agent stated even closed accts that are on the books would get notices anytime CapOne sends one out...HTH
