Convergent Outsourcing / LLNV Funding / Metris - Fraud?

I have read around the forums looking for information about a settlement offer letter I received from Convergent Outsourcing. The letter states that their client , LLNV Funding is willing to settle on my debt of ~ $1000 for ~$350. The original creditor is listed as Metris. From my reading I see that Metris is likely HSBC. Well I dont recall ever having an HSBC credit card at least not in the last 10 years or recent memory. So I checked on my credit report, all my scores are in the 700's. I dont even have a late payment on there much less a bad debt.

 

I did have two HSBC accounts on there that appear to be the same account, just with the XXX's in different areas of the account number. But those are old accounts opening in 2003 and closing in 2005 with a zero balance. I dont even recall ever having an HSBC account, but if I did I know I was sure to have paid it when it was due. There are also 3 listing of what appears to be the same chase account which I also have no knowledge of ever having but they are listed as open and have a 0 balance. WTF?

 

There is a slim possibility that this could related to when I had just turned 18 back in 1998 and I as a dumb kid realized I could apply for a credit card without even having a job. I think I got a card with like a $400 limit on it or something, which I am pretty sure I didnt pay at all, but a couple of years did pay a collection agencies. Regardless, if that is it I believe it is way past the SOL. I live in Texas and am 32 years old now.

 

This is the second letter I have got from these people, I am considering sending a Texas version of a debt validation letter, a cease and desist letter, or just ignoring it. What do you guys recommend?

 

Also, I assume I should get those accounts I do not recognize removed somehow.

if you were sent a settlement offer instead of a " we demand you pay this immediately" letter,

 

it's a good bet that this is beyond the SOL

 

and that the account has been passed around from JDB several times that they don't have adequate account records.

 

it may not even be yours.

 

modify this sample letter

please don't just copy and paste verbatim with the same formatting - these form letters lose effectiveness over time because the JDB's come up with thier own form letter in response.

 

make it your own.

sometimes you're a victim of ID theft and don't know it if the account is paid off. sometimed it's just a file mix up.

 

also, remember providian accounts were bought out by WAMU and WAMU subsequently bought out by Chase.

 

 

 

You can contact Chase direct with a FACTA letter. ( ID theft rule part of the FCRA..... don't file a regular dispute with the CRA's yet - if you file a " not mine" it never gets resolved.

(list out exactly as these appear on your report )

 

I have never had accounts with your bank, have reviewed all my records for xx years and nothing matches.

 

However at this stage I truly don't know whether this is ID theft or just a case of file mix ups or mistaken Identity

Please supply all information associated with these accounts , including;

 

the date the account was opened

 

the method the application was made - by mail, online or in person at a bank.

 

personal addresses,

 

Billing addresses,

 

copy of account application with Signature and

 

history of transactions and payments.

Please provide the name of the bank these payments were drawn from ( the issuing bank) .

 


if you do not supply the requested and statutorly required information, I will file complaints with the Consumer Financial Protection Bureau for failing to comply with federal rules regarding FACTA - ID theft and FCRA - credit reporting.
