Question before beginning WhyChat's HIPAA process

Well, the good news is that the reporting CA and the OC are in a current business relationship-- the bad news is that if BOTH Eq and Ex are reporting a "paid" collection you are going to have to use the follow up procedures against both the OC and the CA. If only Ex is reporting as a paid collection you can file a complaint against them.

EX finally got back with me about updating my information. I have some good news and bad news.

 

Good news: They finally got my name right.

 

Bad news: Former name #1 is still showing up -- the one tied to the medical collection I've been working to get removed. Also, the collection is showing as PAID on the report.

 

More bad news: only a few of my accounts are showing up. I compared this information with all the information I have for every account I have and realize I still have a couple accounts in last name #2. I am 97% certain those accounts that are missing are tied to #2. I can only hope that once I get this changed with the creditors, it will be updated on my report.

 

Back to the collection: Since this is showing up on both EQ and EX as "paid," do I file the complaint against the OC and the CA? If I am reading the site correctly, I send courtesy letters to the OC and CRA then file the complaint 10 days after the date of the letter?

Have you sent the medical DV to the CA for accounts reporting as paid??

So after going through the whole process (opt out, delete addresses, etc.) and the last account I have (which was paid to OC) is now showing as a paid collection, I try the medical DV for Paid collections?

 

Just trying to make sure I have this correct!

Yes, if that doesn't work then we can work on a complaint against both the OC and the CA.

( of course if it is only showing up on Experian AFTER you do the dv and the follow up letters, then we go another route)

Before finding advice on these procedures, I had disputed a medical collection on my EQ report. EQ completed their investigation and sent me a report stating that the entry has been verified by the CA as being mine and valid. Does this serve as confirmation of a CURRENT business relationship between he OC and the CA?

 

I called the hospital where this bill was originated to get more information and it turns out it was for a remaining balance of $562 after the health insurance paid for my son's surgery back in 2009.

 

Can I use the HIPPA letter process with insert a to pay this off and seek removal form my credit report? What do I do if the OC doesn't cash the bank check?

 

The hospital offers bill payments online so should I use that method?

 

Any help would be appreciated.

THIS IS PROBABLY ILLEGAL BALANCE BILLING- LOOK FOR PATIENT RESPONSIBILITY, PLUS IT IS WAAAAY PAST THE LEGAL COLLECTION TIME AND THE REPORTING CA IS LIKELY A JDB ( JUNK DEBT BUYER) WITH NO RELATIONSHIP TO THE OC
