What to do next? recieved Verification

I recently mailed out a verify debt to Financial Recovery in MN, Resurgent Capital in SC , sent a letter saying that my bill (for which is not mine AT ALL, never went for Bridal Consulting or college for it) was placed with them. and enclosed a verification letter..On the bottom of first letter it says that LVNV Funding cant sue because age of debt and LVNV will not report to CRA and unless i dispute Validity of debt it is assumed mine....

 

Original creditor is Ashworth University, then current owner is LVNV, Letter sent from Resurgent Capital...Letter last month was Financial Recovery...

 

Am I screwed? Or should I send a Letter of dispute validity? It is not mine, they say I paid on it in 2004 but its from 2001...Never did such a thing..

 

The verify debt letter says lvnv owns account number ......... orignated by ashowrth university, aquired by Arrow Financial...Balance was 628 but is now 847.81 and that my balance would continue to change day to day i should call them to find out exact balance

Sorry I sent a VALIDATION letter, just double checked it... Anyone know if I should send another letter being they sent me a verification letter back instead.

If you never went for classes at this school, I would request from them a signed copy of your 'application' to this school. You may need to file a fraud case in order to prove that this was not yours.

Yes, you have to dispute both with Resurgent if they are Claiming that LVNV funding is the owner.

I need you to provide me within 2 weeks a letter of verification that my credit report is clear regarding this matter

 

But just to make sure this isn't a case of mistaken Identity, or ID theft that I don't know about,

 

1.) Please provide the date the account defaulted,

 

2.) Please provide the full name, SS # and addresses associated with the account

 

3) please provide the Original College application with my signature and Identification.

Nope never went to school other than high school..Never did online college either...Whatever it is ;it is SOL anyway.... Not sure if I should proceed further

yes you should dispute, or otherwise they report it to the CRA's See my letter above.

They can't legally report it. As OP stated, the acct is either from 2001 or 2004. Either way, the 7 year reporting period would have long passed. If they do report it, then OP has more ammo for a lawsuit against the scumbags.

The more I hear about LVNV/Resurgent, the more I realize they are total scumbags! They will try to wrestle money out of anyone - they don't even seem to care if they have the right person! Gosh, I am glad that they're not on my tail. But I'm standing up to some other baddies that are just about as dispicable.

 

OP, I hope you stand your ground. This debt can't be put on your credit report (if it is, SUE THEM), and hopefully they will figure out the correct student to harrass... I think that as it is, complaints against them are certainly warranted!

What A nightmare this is turning into be!!! I probably broke the cardinal rule by never call..... I called.... For the 4th time They sent a letter saying it was forwarded for review (this was the 3rd time) BUT they couldn't get a hold of me..... Seriously....

 

They said this was for an online School from 2004 (first time I called they said 2001)... And supposedly i made a 5.00 payment on in 2004, turned to collections in 08. Transferred to LVNV in 2011 and that resurgent now "manages it"

They tried to peddle me for my social, I said no!!!! Upon me asking why they couldnt get a hold of me, they said i had to send a police report or affidavit....saying its not mine and I suspect fraud. So I then asked where is my letter stating this, so I know what to do...OH WE DON"T SEND that kind of paperwork out, you HAVE TO call us to find out. I told them NO, send me paperwork...Woman said they couldn't (she was nice)...I asked for supervisor.(I have his name)..He said we never send paperwork out, you have to call in to find out. Me: so if I had never called, I wouldn't know...Right? Him: yes your right, we dont send paperwork when its in review of what u need to send in...Me: seriously....Im not signing my name to anything for you guys, nor am I making copies of my license for you to HAVE. (per the affidavit)...

 

Other question were thrown around....... I asked if they had original paperwork from this "supposed" University, and was told we aren't the orginal creditor so we can't get that..I asked for proof on paper about the address used and what type of payment used...... Them: Oh we can't get that, we aren't the original creditor.

 

Me: so if I dont send in affidavit or police report, what happens...Him: then we will continue collections...

ME.....Thats nice...Statues ran out years ago anyway........>CLICK!!!!!!!!!!!!!!

 

Should I just not worry anymore? report? Do what ?

You can either file a complaints with the FTC and the SC debt of consumer affairs or just file suit.

This agency has been harrasing me about a debt that I know isn't mine, and I've asked them for verfication of this purported account because I never attended the university they claim, and I wanted to make sure it wasn't a case of ID theft.

 

This is what i asked for;

 

"But just to make sure this isn't a case of mistaken Identity, or ID theft that I don't know about,

and they refuse to provide this information, and they keep sending stupid form letters that they can't contact me to discuss it, and if I don't call them, they will continue collections.

 

I don't know why they don't consider letters " contacting me" and why they state they are going to continue collection without validating the debt. - Isn't this a FDCPA violation ????

 

they are in violation of ID theft laws and the FDCPA. I want them to stop this practice of sending letters and claiming they are going to continue collections without Validation of a debt.

 

I'll be happy to send your agency copies of all the letters with the post marks.
