Success with CACH LLC?

Hey guys, I too am dealing with Cach LLC. I have received letters for a $1500 balance from Capital One. I have not reached out to them yet. The debt is a little over 2 years old.

 

Should I call Capital One first and see if they'll take a payment or is it past that time?

 

I am working with Lexington and they just sent out DV letters. Should I wait for that to come back before calling?

 

I have no problem paying in full for deletion. Any pointers or tips with proceeding forward before calling? Trying to buy a house and would like this thing off my report asap. Thank you in advance.

I don't know if anyone else here has received what I received on Saturday: CACH has filed bankruptcy. I have simply been waiting for the debt to fall off--it's already past SOL in my state. But given their bankruptcy proceedings, I would advise anyone planning to offer to PFD to hold off on that thought.

 

The same for anyone who has been sued by them. When they are in the midst of bankruptcy, they can't be suing others. Their attorneys SHOULD be filing stays of their suits. Given the "quality" of their attorneys, that's less than likely to happen. I would advise contacting the clerk of court, letting them know about the banruptcy, and asking how one files a stay in a court case.

Wow this can be big for us who have problems with CACH. I'm one of those people. They have a judgment against me and they had sent me a letter about a month ago stating that they're going to go to court to garnish my wages. Luckily I don't work at the place they have on file anymore.

 

Maybe after 7 years of not being able to contact me they are going a different direction because they might now be in a rush to collect money??

 

What happens to our debts if CACH is BK'd?

 

Also, I'd be willing to file a "stay" with the court if I can. If it goes through successfully, would I be able to get a mortgage if CACH technically can't touch me during that period of time?

Do they take it as far as going back to the court system?

 

Do you think now would be the best time to try to settle with CACH? or would settling with LVNV be better?

no, but they do have to register and file the ownership change in court in order to enforce any judgment thru the courts

 

the court wouldn't allow anyone who isn't the plaintiff listed on the case to file a writ of garnishment - there has to be a legalized change

I can see these posts are quite old however I am still interested in success stories with CACH LLC that is showing on my report.

I am considering writing them to validate my debt. Has anyone been able to receive correspondence from them? I am hopeful that they do not possess all the proper documentation and that I can ask them to delete from my reports.

how old is the Debt and what is your states Statutes of limitations?

 

becareful of disputing when you could still be sued.
