Texas Finance Code 392. For non residence of Texas

Does the Texas finance code 392 only apply to people who live in Texas? I am on the west coast. I received a letter from a law office in Texas collecting for CACH, LLC. Can I use the Texas law in my favor, even when I am not a Texas resident?

It could be done but you need to carefully evaluate the case. Not enough information in this thread to say whether it would be worth pursuing or attempting...

 

Centex; this question is asked a lot. Could you outline some items that would help to determine if a person outside TX could use TX law against an in-state CA?

The two primary things I would be looking at were whether the company was based in Texas and also whether they were in compliance with the bonding requirement. It also needs to be balanced against what laws exist in the state of residency. I would also opine that crafting letters for cross-state jurisdiction need to be tailored (ie. written from scratch) to the specific set of circumstances and need to avoid the generic tripe that runs rampant...
