I just recieved a letter from a CA :x that is based in North carolina where the debt supposedly was accrued. I now live in Ohio, my first question is do I follow NC's SOL date or OH's SOL?

 

The next questions is:

Should I send a verification letter to them asking to verify the debt?

I don't see how they will verify it, because there is no way the $298 is from an electric bill from a 2 bedroom house. The supposed debt is from over 2 years ago. I have actually already disputed with CRA and am waiting on results from that dispute. Should I wait out the 15+ days remaining on that dispute before I do anything?

 

PLEASE HELP, trying to get this off my CR.

I think that falls under goods and services, which is 4 years in NC. Ohio, I believe is 6 years. Normally, if you move from state A after the debt is out of SOL, State B's longer SOL doesn't restart the clock.

Needs to be handled much like any other debt.

 

Firstly - is it reporting on your CR's? Is this the first notice you've rec'd from them.

 

You can request validation from them, which sounds prudent.

 

I assume you are asking about SOL regarding litigation on the debt? It depends where they file, really. If the file back in NC, then the NC SOL applies. If they file in OH, that state's SOL applies. Certain states, such as mine, specifically addresses out-of-state notes, contracts and judgments.

 

It's been my experience that OH is perhaps the biggest turd of a state that I have ever dealt with/travelled thru.

This is the first thing I have recieved from them. I am going to send out a varification letter asap.

 

OK, so since they filed it in NC the SOL is from NC. It is 2 years old now, so I have another 2 years till it should in fact fall off, but I need/want to get it off of my report ASAP.

 

I thought that there was something in the law that states that Utilities and the such can't be posted on CR's. Is this true? I heard this from someone that I work with, and thier credability isn't all that...if you know what I mean.

 

Should I wait till the dispute with CRA is complete before sending the verification letter? I know I never signed anything for this service. Will that get me out of it?

It's not going to fall off on its own until it's 7 years old. It becomes uncollectible after 4 years.
