And what is so Effingly Great about this, is that soon as a Civil case like this goes forward,

 

The States, CFPB or the FTC steps in and goes after them also

So, once it's established that LVNV funding is just a collection agency for the Sherman group,

 

Every state that requires CA's to be licensed and registered could go back and throw out all the judgments like Maryland did.

Dismissal of all 3,500 cases currently in system worth 7.5 Million

SFG owns Credit one Bank and banks in Brazil and Mexico

 

they could afford to buy out these banks because of the money they made on Resurgent Capital services collections and lawsuits all claiming that LVNV funding was the Owner

OMG! Newbie here and you just gave me the courage to fight LVNV. I’m currently fighting Midland, and now LVNV. Unfortunately, they’re both within the 4 year SOL in California

California has a borrowing statute and Choice of law ruling - depending on the original lender's Choice of law in the card agreement , a 3 year SOL may apply, not the California 4 year SOL

361- When a cause of action has arisen in another state, or in a foreign country, and by the laws thereof an action thereon cannot there be maintained against a person by reason of the lapse of time, an action thereon shall not be maintained against him in this state, except in favor of one who has been a citizen of this state, and who has held the cause of action from the time it accrued

Got these bastards deleted after a year of War

 

1. I hired a credit repair company last April 2017 and after the first two rounds, I canceled my subscription after noticing they were doing nothing special. They were also stretching out the dispute times to have me pay the monthly bill without them actually doing a thing.

 

2. Started doing my own research

 

3. got sued by LVNV funding and dealt with them using the info I found on this board -- Paid them nothing after their threats over the phone.

 

4. Disputed with the CRAs and it was verified as mine by all 3 - typical e-Oscar crap

 

5. Followed Why chats method - cleaned up old addresses and then disputed again and still got verified maybe it was too late for that

 

6. didn't think I could do this since I already got sued but I did it anyway as last resort. - Sent debt validation letter to LVNV funding - CMRRR

a) They did not respond, so i sent in another dispute to all 3 CRAs

B) filed a complaint with CFPB and attached evidence that they failed to validate and did not respond even though someone signed for my letter so they clearly got it.

 

Woke Friday Morning - LVNV funding gone from all three reports...

 

Took a whole damm year but it was worth it. didnt pay em a dime .. off my reports and case dismissed

 

ps They mailed letters to my old address so I never got any of them and also hung summons on my old address door. I got the case dismissed because they did not properly serve me. New York has a law about this that i used to my advantage -- not sure about other states.

 

They lied and made up a person they claimed to have given it to .. the new tenants in that place are Mexican lol .. lets just say the person they described leaving the summons with does not fit the description of the new tenants.

 

hope this helps someone with these sleazy bastards.
