Discovered New Judgment

I was just notified by Truecredit that a judgment was just granted against me. I have fought off CA's on this one for four years. Each time I DV one collector, they pass the account to a new one. The judgment was from a new collector that I had never heard of. I never received a letter or phone call from. They just went straight into court and got a default judgment. I never received a summons about the court date. The account is past SOL in my state. I spoke to the Clerk of Court and she said I could file a motion to have the judgment vacated. She indicated that it would be easily granted in this court. She also suggested that I write to the lawyer that handled the case to see if they would vacate voluntarily. I don't hold out a lot of hope that the collector's lawyer will say, "Oh, I am sooooo sorry. We'll just vacate that judgment right away." What do you think?

Should I bother writing to the lawyer and collection agency or just file the Motion to Vacate? Your opinions will be appreciated. Thanks.

I don't have a lot of experience with those things, but I will say the court looks more favorably on people who put in their due diligence, I personally would write the attorney, and let them know that you will be filing to vacate the judgment. That is just my opinion...
