Cap One thinks Federal laws do not apply to them in many instances I did contact my lawyer about it, and they said it's in my hands to work it out. What I'd like to try is getting it removed as 'not mine' first. If that doesn't work, per my lawyer, I'd have to send them my BK paperwork proving it was included. BoogerRed Posted July 1, 2006 Wow you have a real winner for a lawyer there. I had the same problem with Capital One and he fired off a letter via fax and overnight same day I reported it to him. They claimed they weren't included in my no asset chapter 7 (they were) and he gave them 3 days after his response to remove. Cushie Posted July 1, 2006 Send them a letter (CMRRR) telling them that they are not only violating the BK discharge but also (if it's reporting, which it sounds like it is) the FCRA. Give them ten days to remove it from your credit report. Find a good attorney, NACA.org has some, and if they don't remove it on the 11th day you need to sue 'em. In BK court and federal court.
