after BK, says I still owe $15k!

I was discharged with Ch 7 in Aug 04. Cap One STILL says I owe $15k, even though this was included in the BK. How do I go about fixing this??? What sample letters can you show me? I can't get a credit card, mortgage, or even a new apartment. HELP!!!!!

Get in touch with your Atty. if you included it. Cap One thinks Federal laws do not apply to them in many instances. GL!! :good:

I did contact my lawyer about it, and they said it's in my hands to work it out. What I'd like to try is getting it removed as 'not mine' first. If that doesn't work, per my lawyer, I'd have to send them my BK paperwork proving it was included. Do I have a chance to remove it as not mine???

Wow you have a real winner for a lawyer there.

 

I had the same problem with Capital One and he fired off a letter via fax and overnight same day I reported it to him. They claimed they weren't included in my no asset chapter 7 (they were) and he gave them 3 days after his response to remove. They folded like a cheap hooker with a four dollar bill infront of her for incentive.

Send them a letter (CMRRR) telling them that they are not only violating the BK discharge but also (if it's reporting, which it sounds like it is) the FCRA. Give them ten days to remove it from your credit report. Find a good attorney, NACA.org has some, and if they don't remove it on the 11th day you need to sue 'em. In BK court and federal court.

 

They are violating so many laws it's not even funny.
