It went to CA, it is past sol, the bill is from 7/97, it was in OK, I live in GA now. Though I did live in OK at the time.

 

I read on these boards that they can not collect across state lines. Is this true? Is it a violation?

They can definately collect accross state lines.

 

I THINK the CA needs to be bonded in GA though if they collect from (I think) 20 people per year in GA. Check the GA laws on that.

 

I'm wondering if the SOL is up on this though...

 

You'll need to check your state laws regarding SOL (for OK).

There was a post a few weeks ago that asserted the opposite...Something about UCC & Competition between utility companies...Says there was some statute that one Utility company couldnt collect for itself in another state where he would be a competitor...I dont remember the specifics but as soon as I finish my reply to Sassy's post and 1 other post about Suing in State of Md..I will look for that...

I think perhaps a CA can collect out of state, but the utility ITSELF cannot collect. I'm going through this with new jersey power and light...and obviously I'm not in NJ...

Utility bills are bills for services, they are not contracts.

 

They are covered under the standard 4 year UCC, goods and services.

 

In addition, there can be no legal collection on a utility bill outside it's service area, even if it were within SOL.

 

Send them a cease and desist, the "SOL" letter is not, in my opinion appropriate as it implies you believe they would have the ability to sue if you were within SOL.

 

That assumes, of course that you are outside their service area now. If you are still within their service area, send them the SOL letter and refer to Va. UCC Statutes.
