    Garnishment Help

    Hello all. Georgia resident here with a few questions about garnishments: Edited to add: Due to an ongoing illness and medical costs I have 3 revolving accounts that have went to collections. A CA originally filed a judgment summons in my county of residence. I was unable to attend due to a hospital stay and the judgment was awarded to the CA by default. The CA then proceeded to attempt garnishment action in my county of residence, but my work agency requires filing garnishment actions in the county where our home office is located, which is Dekalb County. The garnishment was enacted and was satisfied on Jan 15th after 6 deductions were taken from my paycheck. On Friday I received several "Ambulance chaser" offers from various law-firms in the Atlanta area wanting to help me stop a garnishment that was filed by this same CA on Feb 21st in Dekalb County Court. I have yet to be served any summons or notices of actions by the courts or the CA. I was under the impression that a seperate Judgment had to be obtained for each garnishment action that was filed. Can a CA use a single Judgment as a means to garnish a persons wages for more than one account?
  2. I paid the OC before finding this program. The CA updated the collection on TU to "Pay Status: >Account Paid in Full; was a Collection<" The website for the CA states all of their collection programs are "designed to be consumer conscious and are HIPPA and FDCPA compliant." My question is will this will this program still work for them?

    Old lease collection question

    Trying this again since i have more info- I have a lease from 4 yrs ago that’s been reporting as a collection. It was an eviction due to them getting sick of me paying two weeks into the month with late fees attached . I called the property today because i think the amount they are listing is incorrect. Apparently there is a new management company and i got this response..can i use this to my advantage? I do know NCC has the debt and is still reporting the original company I rented with as the owner. Any help would be GREATLY appreciated.. ——————————————- We have recently purchased the community and changed management teams as of 01/04/2019 therefore, your account and file information was part of XYZ Company. I would have to refer you to them to find out what collection agency they placed your file with and how to get this resolved with them as the debt, if any, is owed to them. Please reach out to XYZ Company here in town and inquire about your home, 11-406, here at Axxxx and they should be able to provide you with Katherine’s information to reach her or another person in their management team that could assist you in finding the collection agency used to resolve this matter.     Is a lease considered an open account or written contract? Logic is telling me written but I’ve here due to how leases are paid, it could be open. I’m in Virginia so it’s 3 vs 5 yrs difference. thanks!

    NCC account question

    Hi, I have two Collections left on my account. I have PRA which I believe I’m going to pay in full just to get them to remove it off my account. It’s not very much $$and I can afford to do it, so I can get that one off my reports if their removal of complete payments that I’ve been reading about is correct. My main issues with NCC. I’ve got an old lease that ended about 4 1/2 years ago. It was an eviction due to late payment- i always paid my rent late, with late fees, and they got sick of it lol...I disputed with NCC one time last year which wasprobably not smart considering I was still with SOL. My reports came back as “updated“ but I don’t believe I ever got any verification sent to me. At this time, would it be smart for me to go after NCC again? My reasoning is if they were going to come after me they would’ve done it last year when I disputed with them. I’m thinking they may not have any concrete proof of the debt. Or would it be smarter to go after the OC and see if the amount they are reporting is correct. I don’t believe it’s correct because, as i said, i always paid and The landlord even gave me an additional week to get my stuff out of the place after the evection. I don’t believe she would’ve done that if I owe them any money. Any input would be greatly appreciated.

    collection dispute, need advices!

    Hi gurus here, I got a collection on my 3 CRA reports, for a utility late bill on an apartment which I moved out since 2015. My previous roommate continued using my utility account without my knowledge. Once I saw the collection, I contacted the roommate and he paid off the debt. But as you expected, since he paid off the debt already, i don't have much to argue with collectors. My credit score dropped 100 points (This is the only collection I had in my life) Before i found out this site, I've started with lexington laws service (yeah i might be very wrong) roughly a month ago, and they mentioned they sent out letters to all 3 CRAs already. But nothing changed on my scores yet. After reading valuable posts here, I want to dispute with CRAs myself this way: I have evidences to show I weren't living at that apartment since 2015. (I can provide my new apartment lease / utility bills during 2015 to 2019. I even moved to another state since 2017, and started a new job here), and my identity is used by somebody else. Is this a valid dispute strategy to go? Any advice will be appreciated!
  7. I just got a call from Comcast. They say I owe $185. This is accurate as I had moved out of my old apartment me and my brother were living in a few months ago. Everything was in my name Electric, Internet and Lease. So to try and help my bro, I kept everything in my name and he would pay me directly. Well after months of him constantly being late with the all the above bills I was already fed up. Then this morning I get a call from a collection agency called Diversified I think, saying that the Comcast Internet had been charged off and I owe $185. The charge off date was barely July 16 2017. It has not showed up on my Credit Reports yet. So my question is, should I call Comcast directly to pay the remaining balance? So that it doesn't show up on on my Credit report? Or should I pay CA? It hasn't showed up on my CR yet, and I'm trying to keep it that way. Oh and I'm done trying to help out my bro, I'm going to take everything out of my name. I worked hard fixing my credit with the help of Creditboards, and I'm not gonna let it go down again. Thanks!

    Credit One sold to LVNV

    I had been making great progress in my credit journey and had a pretty good credit score. Back in 2013, I opened a CreditOne account (which I didn't need, and shouldn't have done...but they offered and I accepted). And then I lost my job. My replacement job paid more than 30% less than I had been making for the last many years, and the CreditOne card ended up being charged off. I have made a lot of financial adjustments, and am in a MUCH improved situation now. But I still have the CreditOne charge-off and the account has been sold to LVNV. The CreditOne limit was $950, but I don't really know what my true high balance was. The LVNV claim is $1317. I am able to pay the full amount. I really want to just settle this one out and get the best possible result for my credit report. I have pretty decent credit other than this. I have an auto loan with Chase, credit cards from Citi, AmEx, and Cap One. So making the CreditOne debacle go away is my big issue. Any suggestions would be greatly appreciated.

This is a 'continuation' of my original post in the medical billing forum for Wakefield & Associates that is not medically related - and mostly intended for WhyChat: So I received my Equifax report today and only have two tradelines on it. A current credit card, which is never late, etc etc. However, there is an entry from Jefferson Capital for an old debt from Verizon (not sure how it got to be $561 but that's not relevant here). I need your opinion on the following: I was able to retrieve my old credit reports from 2014 off of an old external hard drive. My most recent Equifax report dated 12/10 shows: (Jefferson Capital) DOFD: 01/2013 DMD 1st Rptd: 12/2015 BOTH of these are clearly and undeniably incorrect. The actual dates - from reports from 2014 are: (Verizon - OC) DOFD: 02/2013 DMD 1st Rptd: 08/2013 One is off by a month and the other is off by 2 yrs, 4 months. The most important one being the date of first major del. My questions are: 1) Should I do a regular DV with Eq asking for: "Please advise me as to the name and address of the original creditor, the name of the account holder, and the reported date of first delinquency,as any account I might have had at one time would be obsolete. Please advise me as to the correct name and current address of this creditor, the name of the account holder, and the reported date of first delinquency,as any account I might have had at one time would be obsolete. If you can obtain this information, I also would need the name of the person providing this data, and the manner in which it was provided in order that I may pursue additional legal remedies." https://whychat.me/initdispltrsol.html (With blue background/blue handwritten ink) (The above is what I sent to TU & Exp and am awaiting on their response.) 2) Or should I do a "jack attack" that I have seen on here where you dispute each and every entry? 3) What is the difference in sending by priority mail vs. certified. Both can be tracked and neither has to be signed for. About a $3 difference in cost of mailing. Just curious.     Past SOL Debt Collection

    Hi! I could use some advice. Whychat? Out of the blue, I received a settlement offer from EOS CCA in Boston, a CA for "current " creditor, U S Asset Management, Inc. It says the original creditor was Century Link Qwest and gives the original account number as my old phone number. This number was disconnected when I moved on Nov. 1. 2011. This is past the SOL. There is no original date on the letter. The letter does say that the original amount is $176.36 with no interest or fees. This seems a bit high but I do not remember the correct amount. I forgot all about it. I did not receive collection letters and it never reported to the bureaus. I would think that the information contained in the letter covers everything which a validation letter would generate. So what plan of action do I take? What letter do I send? I opted out 3 years ago but have since obtained more CCs. Perhaps that left me vulnerable to data miners. I have opted out again. Your help is appreciated. Jaybird

    Collections Account Advise

    Hello, This is my 1st post, I'm really glad i found this place. I've been reading here for hours and while I'm 100% better off than i was I'm also a bit overwhelmed with all of the information. I thought a post requesting specific advise on my issue would help lead me out of the fog. I am in the process of preparing to apply for a mortgage. On my credit report there is a collection for a utility bill in the amount of $9700. I honestly have no idea how my name was associated with this account other than the fact that i did have the utility in my name after this date for a short time and for 2 years before in 2008-2010 at this address. The address listed is my old house but from a time frame that my father lived there. To clarify i lived there from 2008-2010. I called the DC and they gave me information over the phone stating the address and the delinquency date of the bill (April of 2013). My father passed away in March 2013 so the dates make sense that his electric bill had not been paid in some time. I transferred the utilities for this home into my name at some point in April 2013 until the home was sold in late 2013. I know for certain and have evidence that this bill was paid after it came into my name. It seems that they are trying to pin the prior amount owed before it was in my name onto me. Long story short it isn't my debt but its on my credit report wrecking it. My payments are actually listed on my current utility account with the same provider because i had a current account with them at my current home at the time and when i had my fathers home added they just added it to my current account. This debt is past the statue of limitations to be collected but apparently not too old to be on my report until 2020. I talked to the DC again today on the phone (I know now and wont do this again) and requested they they send me validation which they said would be an itemized copy of the bill. I also offered to settle the debt at 10% to have it removed from my credit report because time is a factor for me on getting approved for this mortgage. I was careful to be clear that i was not acknowledging this debt was mine but it was worth $900 to me to save me the aggravation. They flat out declined and came back at $7k. I said i looked forward to their validation. I have not disputed this with the CB only verbally with the CA. What is my next step? Do i just go right to the flow chart pinned in this forum and get the paper trail started Monday morning with a written verification request? Have i shot myself in the foot in any manner thus far? My fathers estate is closed, but i was the executor/administrator. I do not think this legally ties the debt to me although i could be wrong. The lawyer did send out notice to all of his creditors and it's almost like someone at the utility company just put my name on his account. The DC is telling me my fathers name is no-where on the account in question, not even as a 2nd name. Any advise would be greatly appreciated.
  12. The first dunning letter is for an alleged old medical bill for $900 Collection Agency is Dynamic Recovery Solutions. They give me three payment options but down on the bottom it says they cannot sue me for this debt nor report it to my credit reports. How should i handle this one? Just ignore them? The second one is not a medical collection but from the same CA. It's for an old cell phone bill for 200. Again down at the bottom it says they cannot sue me for this debt but they can report it to my reports. I have a feeling this comes from filling a complaint with the BBB against Jefferson Capital Systems last week. I filed on the 16th and these letters are dated for the 15th. Coincidence? Just an fyi the phone bill lists JCS as the "current creditor". May i also add that after complaning to the BBB then disputing JCS to the bureaus they did remove JCS from all 3CRA's. How should i proceed? Thoughts
  13. Hi, I’m new here and could use some help. Sorry in advance for the extra long post. In 2014 I was in an auto accident and ended up with five herniated discs in my neck. This led to migraines that landed me in the ER six times that year. I had medical insurance with a maximum out of pocket of $500 for the year. All six ER visits were to the same ER facility. Somehow they messed up the billing on three of the visits. I received bills from the hospital for the visits and the amounts not only exceeded my copay, but they exceeded my out of pocket maximum. The hospital was an in-network facility. The EOBs that I received from the insurance company said that the provider had not properly billed for the services performed. I called the hospital’s billing department. I was told that they were refilling the insurance and if there was an issue that I’d receive information in the mail. They sent me nothing. As it turns out, I ended up in collections for all three visits. I had a total of six collection accounts - three for the hospital and three for the doctors association. I was livid when I found out (I was trying to finance a new car and the dealership showed my the collection accounts). So I called the hospital billing department and sternly voiced my displeasure. I even threatened legal action. They said they’d look into it and get it handled. The hospital actually followed through and removed their three collections from all three of my credit reports. Unfortunately, the doctor’s association billing department wasn’t as easy to deal with. They contend that I owe them close to $2000. I explained the limits of my insurance policy and that the EOBs I had received showed that they had not properly billed the insurance. Their response was basically “too bad.” They said that I could pay them the full amount that they claim is due and that they’d report the collection as paid. I told them that this is ridiculous and that I want it removed. Once again, too bad. So I called the collection agency and explained the situation. I was told that it’s between me and the original creditor. A couple months ago the collections were completely removed from my Equifax report. I’m not sure why, but fine by me. But the collections were still listed on TransUnion and Experian. I initiated disputes with those credit bureaus. My disputes were all denied. But for some odd reason one of the collections now shows as closed (still with a balance) on TransUnion. At at this point, even if the doctor’s association were to try and resubmit the claims (which they’ve said they won’t do) they can’t. The insurance company I had in 2014 no longer operates in Florida. There isn’t even a phone number to contact them. I need to apply for auto financing again soon, and I need this cleared up first. I have no other collection accounts and no delinquencies or late payments. The three remaining collection accounts are the only negative information on my credit reports. So, what are my options? How do I get these collections removed/deleted? Thanks in advance, Daniel
  14. I have a TL on my TU and Exp reports (still waiting on Equifax) from Wakefield & Associates. Under "Loan Types" they are listed as "Collection Agency/Attorney. I have went to their website and read each of their "exec team's bios." No where do I see any mention of any of them being an attorney. I have disputed this with TU & Exp in writing, by certified mail and not on-line, which both received on Thursday, 12/06/18, because I honestly do not who the OC is. I guess my question is, when the disputes come back as verified, as I'm guessing they will, what are my options considering all the other info indicates it is still within the SOL. I am assuming I will begin to get letters or phone calls from them. But.... and this is the interesting part What is really interesting is the TL also says "Acct Info Disputed by Consumer; <Placed for Collections> I have not disputed anything on my credit reports since some time in 2014 (?). "Placed for collections: 04/29/18" Date Item to be Removed: 04/2024 (which indicates an original date of sometime in 2017) ????? (Confused? I am) And the balance seems to be increasing over time a few dollars per month. Original Creditor: Medical Any help/advice/opinions will be greatly appreciated (I may not be able to get back here immediately to respond to anyone but will return soon). Thanks in advance.     Credit Card charge off from 8 years ago

    Hi, there was a wells fargo account credit card account that was charged off years ago in 2011 but the accounts last payment is showing 2013. here are some more details: Account Status Closed Payment Status Charge-off Status Updated Oct 1, 2013 Usage 125% Balance $1,498 Balance Updated Jan 2, 2019 Last Year I received an IRS letter stating that I didn't report the charged off amount as income for my 2016 taxes. Wells Fargo cancelled the debt and sent it to the IRS on the last day of the year in 2016. As soon as i received the letter i paid the debt in full. Here's where I'm stuck on how to proceed. My credit report still shows the full charged off amount even though I paid it to the IRS when requested and i cant get it removed no matter how many times a dispute it. According to experian the account will be removed from my credit report at the end of this year in 12/2019. I need some more information because I don't want to do anything have the clock be reset on when the account will be removed. ( I'm afraid of a situation where if any new information is inputted resulting to a reset of the 7 year rule) Should I give up and wait for the account to be removed? Or should I press further and keep trying to have it corrected. And if I were to do so, what is the best way of going about it? Thank you so much for the help.
  16. I have a $126 "Paid" collection dated Nov 2013 on my credit reports. If it is relevant, I'm not sure if I paid directly to the CA ("Med Data Sys") or directly to the hospital. I am wanting to know what steps I can take at this point. I've read through WhyChat's links (geez, what an awesome resource!) but I am still unsure exactly what I need to do. It seems like I could send the wrong letters (or in the wrong order) and screw things up. Thanks in advance for any help!
  17. Hello! The day after Christmas, I checked my EQ report and found that a particularly scummy CA that's known for this practice dropped a collection on my previously clean report. It's an alleged payday loan from 7/2012. The CA has never contacted me in any way. I see from my research that reporting a collection on a report is considered to be first contact. Since then, it's been added to TU too. As I craft my dispute, I wanted to confirm a few things and how to word and prioritize the items on my dispute letter. 1. The date it was assigned was 12/19/18. 2. The date it was reported was 12/24/18 (obviously, this doesn't allow for the 30-day dispute process, but if reporting on a report is first contact, that may be moot...?) 3. Since that first contact, including allowances for the holidays, I have not received the required dunning letter within 5 days of first contact. 4. In reading the April 22, 2017, post from ICanHasMuny? on this thread (link at the end of the post), this type of account shouldn't even be reported: "EX TU an EQ won't accept the following information from furnishers effective june 2016 - so if you have this type of information still on your reports, DISPUTE IT OFF ... check cashing companies payday loan companies" I'm pretty hacked off about this... the DOFD is 7/2012. I don't have an exact date yet. I appreciate any guidance on disputing this, especially regarding the wording and citations. I haven't had to deal with any negatives in a few years, and this was a shock. Thanks very much!

Scores EQ538 TU587 EX638 Amex blue 10K / 4K bal Amex Every 10K / 7500 bal BOA Alaska Air 4500/ 3900 bal DISC 6300/ 4200 bal BECU 2K/ 1500 bal Cap 1 800/ 0 bal CITI 1K/0 bal Credit one 950/ 0 bal First Premier 1K / 0 bal First Premier 400/ 0 bal Student loan 9500/ 9270 bal I was at 690-710 on my scores then loaded my cards, killing my scores from over utilization. Along the way I was dealing with a federal agency penalty which before it got through with the appeal/contesting/adjudication the person I was dealing with retired, and the division of the agency closed now sending all penalties directly to Treasury. Soooo Treasury’s Bureau Of Fiscal Service is the taxpayers collection agency and they are tough. Sent me a notice of intent to garnish me (they can only take 15% after tax) and hit EQ and TU with a 40K collection! One of the listings said the account start date was 01/01/0001 that’s 1000 years before the crusades. So my credit repair person immediately verify challenges them. They have now come back twice updated with more info and amounts claimed, My insurance will cover part of it and I have a attorney doing the adjudication challenge with Treasury but the process is slow, maybe a year. So even though the debt is not being avoided by me, and hasn’t been confirmed, they are jamming me up on the bureaus. Im trying a third time verification with EQ TU maybe the govt shutdown will help them miss the 60 day window. But I’m dead on those bureaus. I tried my CU but they pulled TU and that’s how I found out about the Treasury listing. HELP: I know my EX score is low from loading up my cards, won’t a consolidation loan get my score back up? EX has 5 inquires 3/18 11/17 11/17 11/17 10/17 I’ve gotten the typical mailing from BestEgg and was about to click the button but waited, wanting more info. Here on Pulls it looks like they only pull EX? I need to figure out how, if it’s possible for me to do this. In the mean time I need to get a car, a person I’ve been working with says the finance person has banks that only pull EX. I have a good job, 70K at it 8 months, went to school last year to get the job. years of credit history, only 3 lates from over two years ago. Qs: 1. Where how to get consolidation loan to put out card fires. 2. Apply for consolidation or car loan first? 3. If I can get more then I need on consolidation should I take it and use extra to pay down balance then it will show less then 100% on my report and now count as bad? 4. Is there any hope I can pull this off? 5. The BestEgg prequalified offer is good only till Jan 9 so time is ASAP crucial, I haven't clicked through on it yet so they haven't run me, and they are emailing me to continue.   19. I have a medical collection on my TU account only from OAC for $537.00. The debt was from a Xray visit in may of 2014. Collection was placed 1-2015 and continues to update. All other bills at that time were paid by American Family who the was apparently reimbursed by the commercial insurance policy of the company whose truck driver hit me from behind. They paid all phys therapy, doctor visits, etc during that time. I do know for absolute certainty that I gave them my AmFam card prior to treatment just as I did for all treatment. What is the best way of dealing with this? Thank you.
  20. Last year our baby was moved to NICU the day after born claiming for infections and was advised that baby would need a week of medication and observation. Baby showed significant improvement from third day and all the medical apparatus were removed other than monitors. During the last two nights on baby's hospital stay we were informed that we can spend time with baby in normal room which we agreed to and was handed to us without no medical apparatus including monitors. We were told baby will be taken for medication in the morning and in the evening. Left facility after paying wife's charges. Later received 2 separate bills for the baby one from NICU hospital facility and other from NICU care which they charged for all 7 days at NICU rate without excluding the last 2 days. Also the baby was admitted on first day in the evening and they even charged full day for that. My insurance paid them and left with my portion. I disputed these 2 bills wrote letters and called but all went in vain I requested for health records and the medicine administration sheet doesn't show any medication after 4th day but in a different notes other than medicine administration sheet it was written they will be continuing the medication till day 7. Reached out medical facility and NICU care about the discrepancy and they kept claiming to be billed correctly. I have received a letter from CA about the NICU care charges and mentioned that NICU care has asked to report the charges to CRA.     I just got served by the local Sheriff's department a judgement notice on a debt that was discharged on my Ch. 7 filing from 2012. It is from a law firm so what do I need to do? Send a copy of the chapter 7 to the local sheriff's office and law firm? And can I counter sue on any grounds of this group trying to collect on this debt?     Dispute Help Needed

    Hello I have a Collection Account on Transunion from Plaza Services and apparently they only report to TU. I have never recieved a dunning letter from them or any letters. I have lived in the same address 15 years. I sent Plaza Services a letter for proof etc with no word back and disputed with TU. TU came back as verified today with no other explanation etc. I could use help from here as I haven't had this happen before with a dispute. Thanks
  23. Living in Texas and law firm has Texas address. Was contacted by Rausch Sturm law firm who say they are representing portfolio recovery associates. They list the original owner of debt as Barclays credit card so I know it’s real. I want to pay the debt. It isn’t past the 4 year statute in Texas because original debt is from 2016. However, They do not indicate an offer. They just indicate I can contact them via phone or mail to discuss options. Should I wait till they make an offer? Should I call them or write a letter? I’ve seen websites discussing advantages of both calling and mailing so I’m not sure. I can afford to pay as much as 2000 of the listed 10k. Or can I do some kind of hardship payment plan? The law firm haven’t offered either option. Portfolio Recovery did, but I guess these guys have the debt now, so should I make a first offer or wait?
  24. Not a newb to credit scores, but newb to this board, hello all... I'm sure i'm not the only one that has gotten those offers in the mail offering to settle a debt for 1/4 to 1/2 of what is owed. The question comes up of, these offers i've received seem good and all, but they're from 3-4 years ago. I know ~7 years is when stuff starts falling off, so granted I won't need an immediate hike in my score anytime soon, would it make more sense to continue to refuse to pay any of them, and be better off just doing the wait game for them to fall off in a few years? Thoughts?
  25. Hello all, I am new here and hope I can get help understanding more about credit repair and scores. I am in the process of cleaning up my credit file in order to get a better credit score. I have collections accounts and charge off showing on my reports. I have a total of 5 collections showing on Exp, Tru, and 4 on Eq. I have send a pay for deletion offer and I am waiting for the response. I would like to know how many points I should expect to see increased if and once deleted. Right now i have a 610 Equ, 578 Trans, and 560 Exp. All 5 collections are 1 year or less old. The charged off account show 0 balances on Equ, but still show a balance on Truns, and Exp. Can i get some insight on how I can get my reports cleaned up. Trying to refinance my mortgage Thanks in advance
