I have an old debt from an HSBC account from almost 10 years ago that Cohen & Salomowitz sued me on. The debt was for about $250. It was from 2003-2004. C&S sued me in 2009. Now here is the kicker. They sewer served me. I had no idea about the suit until I began receiving settlement offers from them in the mail in 2011. They like to send them around tax time & at the end of the year. I went to the court & verified they did indeed sue & get a default judgement found the default judgement in the system. I was never mailed a summons, I was never served in person. I also never followed up on it. I just left it alone. Now I had successfully disputed this account off my reports years ago, roughly around 2005-2006. It's never shown up on my reports since I disputed it off & neither has the judgement. Since CAP1 bought HSBC I have been getting letters saying CAP1 is the new owner of the debt & they have been offering 20% off, 50% off etc.. As of today the judgement is a tad under $1300. I received a letter earlier this week for a 75% reduction. It would be $283.00 payable in 2 installments of $141.50 I owe the debt, this isn't like my other situation where I was hosed by an EX. this is mine. I would like to pay it, & put it behind me once & for all. How should I proceed? Should I pay? Should I dictate my own terms? I know to stay off the phone. Should I write them a letter back & send certified return receipt? I was thinking about getting a western union money order. sending it in before the deadline certified mail, than send another money order a couple of days after that & be done with it. Now if I do this, they will update the courts. Will they try to poison my reports with the satisfied judgement & try to reinsert the original HSBC debt under cap1? Advice & guidance please.

I read some blogs about this company on this and attempting to collect very old debts on this site. Has anyone encountered this with them. Of course I was concerned. The company got a hold of me on my husbands cell phone. How they got that number I will never know since mine is 1 digit off from his. Anyway, the debt was from 2001, in my maiden name and the company rep was unsure who initiated the charge off other than it was from Sprint or one of it's subsidiaries, like Comcast . (side note been married for 25yrs) When I asked for the company to mail me in writing ALL the information they had so that I could review it I was told that the company could only email it to me and because the company sends so many emails it would take 5-7 days for me to get the email. I explained to the rep that I will jump on my credit report ASAP and get any information I might also need from that debt. She promptly told me that she could get on and did supposedly and proceeded to advise me of whatever agency she used was reporting, she said I had good credit and I have a good history. I believe the statue of limitations would apply here if this is my debt but by the fact it's in my maiden name lends concern for an ID issue, however the company did have the last 4 of my SS.
