  4. Hi Guys, I've been around these boards since 2006, but haven't posted in a few years. Now, I'm needing some Car advice, please. Situation: My husband and I both had car leases when we filed for BK7 in Jan. 2017. We did NOT reaffirm either of the two leases in the BK7. I was working from home at the time, so I stopped making payments on my car and it was subsequently reprocessed (voluntarily) by Hyundai some 90 days later. My husband, on the other hand, has a 1.5 hour commute to work and decided to continue to make his lease payments, even after the BK was fully discharged. Now, two years after our BK7 was discharged, my husband's lease is now up and he will need a new car. The thing is, he has never missed a payment to Nissan Motor Finance, nor have we ever been late. The car has NO damage, but has a great deal of wear and tear, and is way over the agreed lease miles, currently at 52,000 of the 30k signed at lease. So, we can walk away and owe nothing because it was included in the BK7, OR we have considered reaffirming the lease in order to retain the positive payment history with Nissan. Then it occurred to us, that if we reaffirm the lease, then we will mostly likely have to replace the tires, brakes, and pay huge fees for being over the miles. My husband has been very loyal to Nissan; this being his 4th lease, and he would like another Nissan, just not this one. What should we do? Thanks in advance!   7. I’d like to lease a new car and have a question regarding captive leasing. My FICO’s are in the 630-640 range, my wife’s are 660-670 range. I have always had a feeling the dealers spiked the interest/lease rates to grab more money than what the captive banks offered. Would it make sense to complete credit application at manufacture web site such as Nissan’s or Mazda’s to get approved prior to negotiating with the dealer?   12. Hey there, I recently turned 18 and want to get a new car on my own (parents won't co-sign). I am considering leasing or financing a BMW, as my car is a bit older. The problem is that I haven't developed credit yet. What isn't a problem is my income, I make plenty to pay for the lease estimate ($550/month). I also won't have a problem getting insurance or setting up an auto pay or anything like that either. So, before I go to a dealership and make a fool out of myself (if I can't pull it off), I was wondering what options are available and any ideas. Thanks a bunch.
  13. Good evening all! I have 2 old bills reporting on my CR through Equifax and I need them removed ASAP so I can apply for a biz equipment lease in a few weeks. Would they worry about items that were added to my report 4-6 years ago, or will they look at the recent date of the unsuccessful dispute/deletion (1/14)? If i paid these off and got the CA to agree to a pifd or even agree not to respond to any dispute, what reason would I dispute under? My scores are around 650 and i'm paying down all my cc balances down to 40%-50% so hopefully this will help. The items are listed below, and were disputed earlier this year by a friend of mine on my behalf. I have 4 or recent inquiries to my credit report. Any advice would greatly be appreciated. Thanks!   14. Hi Marv, Quick question, I went to lease my first car at Accura. Everything was going great, UNTIL I got into the finance office. I just want to make note that I wanted to talk withthe finance lady prior to running my credit, as I had some questions. That was not an option. Ok I get in the office and her deamnor was nasty, ok anyway. She looked at my application, asked basic questions and entered it in the computer, next thing I know she said your denyed, sorry and closed my file. I was shocked, U asked the following: reason: not enough credit history Score: 697 ( she said I qualified for their preferred Tier which is Tier 1) (she didn't know if it was auto enhanced scoring, she asked what is that) who did they pull: Experian ONLY what can be done: co-signer who can show payment history She said she couldn't print anything out but moved the screen to show me what America Honda Finance gave her. I saw my one credit card that I opened back in Oct 2013 CL 2000 ( i have 2 other cc I was approved for but are not reporting yet) I have no baddies never been late. my questions MarvBear is: when trying to get a lease approval from the bank, the negotiated price is the amount they are requesting right? In my case it was $34,155 Am I entitled to something in writing stating that I was denied and based off what factors? I never actually seen the denial Should I request to speak to an under writer @ American Honda Finance on Monday and explain anything? (the finance lady didn't know what or who it was) Could I have chosen a different model less than the amount she entered requesting an approval? or is it just denied regardless? Should I try again when these two cards start to report? How long should I wait to retry again? Are there any car financing companies that are first time leasing friendly that you can recommend? would I face the same issue with other car financing companies? Should I just take out a loan from my local credit union and just pay it as per terms just to show that I am responsible? and for how long do you recommend that I have the term for? The income is there and was given proof via 6 months of pay-stubs. I was putting 0 down as I knew I qualified for at least preferred tier 1 I went on a mini app spree, well I only applied for one (and I truly believe that is an app spree) cc and was approved instantly. They pulled Experian despite the fact that 5 minutes prior I refroze it! Even though I didn't drive off with my car, I appreciate the experience!! It has taught me that I can face these car dealers and have the confidence and wisdom to show that I know what the bleeeeepppp I am talking about!!   15. I'll write this somewhat detailed, so I'm sorry for the short story that's about to be unraveled before you. Around early January 2012, I signed a lease with a friend of mine in North Carolina. He was military and I was not. Things fell through rather quickly, within a couple of weeks. I left and made my way back to Kentucky. As I was told, I was signed as an occupant. Sometime in February, we'd somewhat made up to the point where I was faxed a "lease release form". I faxed it back, twice, and confirmed receipt with the receptionist. Due to some moving around and the sale of my truck, I lost the paper. Later in the fall of 2012, I was contacted by my former roomie via Facebook and gave him my number to chat. Moments later, the leasing office from that apartment complex called stating I owed the last months rent for the 6 month lease that I was apparently still on. I explained the document signed and sent. The lady (new, not the one I spoke with in the spring) said no such document was before her. Apparently the complex is now under new ownership. NOW it's on my report, nearly $1000, and still showing his name as well. He was "let out" due to orders of getting out of the military. In short, they had me sign paperwork releasing me when I originally only signed as an occupant. It's now on my report. I live in a different state. What can happen if this sits? I was told by a housing authority rep in NC that since I'm out of the state, legal repercussions aren't likely. He's still showing on my report as a co-signer/lease holder. I can't afford this debt, nor do I feel obligated though I realize losing that paper was my only hope. I'm trying to get my score straight but I don't want to go to jail or face losing any of my possessions though all I really have is a cosigned vehicle which I'm not the main holder on.
  16. Not sure if this is in the right forum, but I'm trying to help a friend out as best as possible. Heres the situation any advice is (as always) greatly appreciated So my friend moved to Holiday, Florida only a month ago and signed a lease on a privately owned house for herself and her 3 children with the intent of permanently relocating there. She just now found out that her mother has fallen very ill and now she must come back to Colorado to take care of her. Her new landlord is not very happy (obviously) and is now threatening to sue her for the entire year of the contract (it states she would be responsible in the contract) regardless of whether or not the landlady leases it out to another tenant. Is this legal in Florida? Any idea what kind of options she would have? My friend is NOT a citizen of Florida yet, although the contract was signed there so wouldnt the land lady have to come here to sue her since this is her place of residence? Thanks ladies and gents
  17. Hey guys. Question to help out the neighbor today. So in attempting to help her with her credit woes, she gave me some detail on a collection on the report and I figured I would dig for insight. The collection is for a broken lease at an apartment that she shared with her now Ex husband. The lease was in the ex husband's name... meaning he was the only APPLICANT, however, she had to be listed on the lease due to occupying the space. She never paid an application fee, had the credit ran or anything in order to do this. With the parties collecting on this lease, does it exclude her from being liable since she was on the lease but only due to being occupant. I could not find much information on this on the general internet so figured i'd see what our experts say. Thanks in advance for your help guys.
  18. So I have a lease I broke in 2011 in collections that I plan on DV'ing. I'm not afraid of being sued because I could settle if I really needed to. In fact I tried contacting my old apartment managers about paying them directly and they said no, I had to deal with the CA. I don't pay CA's, they pay me - so I need to handle this another way. I have already had this verified in a CRA dispute(all 3 reporting). I've had some success with very simple DV letters, however this one is a little different. In my state(Washington), when a landlord takes your deposit/you incur additional costs they have 14 days from the day you surrender the property to get you an itemized cost list. Read here. http://apps.leg.wa.gov/RCW/default.aspx?cite=59.18.280 Neither my wife nor myself recall getting this, and we did leave a forwarding address with the apartment manager. I wonder if there is any way I can use this law to get this off my credit reports, or if I'm just barking up the wrong tree. My initial plan is to DV them, and attempt a 1-2 punch however I thought I'd bring this to my fellow CB'ers and see what you had to say. The CA is FCO, and everything I read says I need to play hardball with them.
  19. I've been reducing my debt for years to realize my dream of owning a house. I've paid off over $70,000 of my student debt over the last 5 years, but I still have $24,000 to go. Still, I am very close to having enough paid off that I can get a house much earlier than I expected. I looked into getting a mortgage recently, but they said that my debt is still too high to lend to me despite having a good credit score and credit history. In an effort to reduce my debt further and faster, I thought that a good option would be to ditch my car loan (19k) and take over someone else's lease. I figure that this way I will wipe $14K off my books, instantly reducing my total debt obligation (apartment rent, car lease, student debt) from $47K to 33K. My other option is getting a used car, the problem is that this would add the same amount of debt or subtract from the 30K I saved for a down payment. I would also run the risk of having to pay for repairs if I got unlucky with a car purchase. On my current trajectory (considering I get rent similar to the one I have now when my company moves) I will be debt free in 3 years if I wait to buy a house. If I buy a house I will be done with all of my school and car debt in a little over 1.5 years and save an estimated 2-3K in Interest. I will also be able to capitalize on the low mortgage rates and have the pleasure of owning my own home. My hope is to get a $70-110K mortgage between December and March. I'd just like a second opinion from some of the people on this message board to see how sound my plans are.
  20. Due to financial difficulty, I had to break my auto lease. The Ally Financial sold my vehicle, and sent me a bill for deficiency in the amount of $5,200. I have received 2 bills from their Asset Recover Center. The debt is still with Ally. I have not hired an attorney yet, What is the best course of action here? I am willing to settle this debt. I have settled multiple credit card debts before for 20-30% of the balance myself, but they were all charged off and with collection agencies. Should I call them directly and offer a lump sum payment or wait until they move the account to the collection agency and deal with them then? I also have an option of hiring a BK attorney and have him/her negotiate a settlement. I live in NC. Wages CAN NOT be garnished here for such debts, i have no equity in home and I can exempt up to 5K in a bank account funds in case they obtain a judgment. I am basically judgment proof. However, i do not intend to neglect this. Any thoughts, comments? thanks in advance.
  21. Hi, My dad leased a 32K ford car and died after making 6 payments. I live at the address and Ford is asking me to payoff the car (it is 27K) to finish the lease off. They asked for my personal info on the phone, I was pretty aggravated at the time and I stupidly did. My dad left no estate and all I own is a 97 Ford Thunderbird and a 96 Explorer. I'm concerned that are going to going to take those vehicles. Ford credit asked about the vehicles I own. I'm wondering now if they can put this on my credit report and if they can collect from me? I ended up arguing with them to the point that I told ford it was not my fault, he was supposed to stop smoking and eating massive amounts of fast food didn't, I jokingly said I wouldn't have given him the car. they don't care in the least. I pay all my bills on time and have a great credit score, I hope I don't get ruined for my stupidity at the time of loss. Now when they call they ask for me. I really don't want to bother with this because I had nothing to do with the purchase. Should I just ignore it? Will they just repo the car and leave me alone?
