Hi All, Just wanted to post this for any of those who might have disputed an Advanta Credit Card account with Experian. I had this exact problem with Experian. Just received a notice in the mail that Experian is being sued for identifying Advanta as the provider of information on Advanta Bank Card accounts. Advanta Bank was taken over by the FDIC, and its portfolio of credit card accounts were sold to Cardworks Services. In typical Experian fashion they continued to verify that Advanta Bank was verifying the account data, even after they were taken over and closed down by the FDIC. It was actually this company Cardworks Services, that was verifying the data. Luckily Michael Dreher has brought a class action against Experian. If you think you are eligible you should join the class. Website is www.advanta-experian.com you can email them at AdvantaExperian@clalegal.com. Or PM me I can email you a copy of the letter. I know people are going to say your only going to get a couple dollars, and that is fine. Hopefully Experian gets hit big time, and realizes it is cheaper to follow the law than pay these fines. Hi Everyone, Kind of new here and I really need some help. I have an entry from Advanta Bank on my EX credit report. EX of course investigated it on November 8th, 2012 with Advanta Bank and they verified it. After googling Advanta Bank and finding out they were dissolved by the FDIC on March 19, 2010, I filed a CFPB complaint. The CFPB forwarded it to the FDIC and the FDIC sent me a letter saying they dont have authority over a non bank entity. They also state that Cardworks Services owns the account. Here is my questions is it legal for EX to say they verified it with Advanta when a collection agency owns the account? I sent them another dispute with the FDIC Letter, how can Cardworks report as Advanta Bank on my EX report? It looks like the OC on my report, but it has to be the collection agency that is verifying the TL? I sent a letter to Direct Dispute to Advanta Bank (Cardowrks I think) requesting a signed account agreement, but got no response form them and it is now well past the thirty days. How can I get this off my report? Thanks Tommy

Carson Smithfield Phantom Payment Letter on old Advanta Card

A client of mine has been waiting out the statute of limitations on an old Advanta business card account and just got a letter acknowledging a payment (which he didn't make) in an amount they didn't specify. He's never taken their calls, never agreed to send them a dime. Between the possibility for re-starting the statute of limitations clock, to setting up an account stated cause of action, to just trying to provoke a reaction, their purpose is of course inscrutable at this early junction. It's a commercial account, so only a couple of cases (shaky ones at that) even admit of the possibility that the FDCPA applies. I haven't decided yet how to engage with them. There will need to be some sort of response. I just wanted to let everybody know that this previously-thought-toothless collector may be up to something.-
