  1. So I need assistance dealing with Capital One, opened an account in 2011 to help rebuild my credit score after post-college debt. I was approved for $300 and always paid it on time. After returning to the country in 2012 from deployment abroad, I started using the card and paying it with a joint account I held with my grandmother. Capital One flagged for account verification and potential fraud. After several attempts to verify my account and identity through email, fax, and telephone. I gave up with a $0 balance on the account and I didn't recieve anything for 2 years from them, hoping they had closed the account because they would not allow me to do anything with it, including close it. Then in April 2014 they began sending me emails that I had an annual fee that was 30 days in the rears and so I called attempting to pay and close the account again only to be told once again that it was flagged for fraud and there is nothing I can do until they get proper paperwork. Of course I attempted multiple times over the past 4 months to correct this error and close the account. I have sent in PDFs and JPEGs of my statements, copies of my DL, SS card, and Checks only to be told they needed something else or the they did not recieve the items. I have even went as far as to do a three way call with my grandmother and a supervisor. My bank has also faxed the information to them. Also note that I have sent each docs multiple times through the email link that they give to upload docs or have faxed them in. Now after spending 3 hrs on the phone today they have told me I have to physically walk into my bank with my grandmother (who lives 600miles away from me) and verify my account that way. After directing expletives with a case manager I hung up.... I am at the end of my rope with this company. Any help in dealing with this? i have disputed with experian, but should I take legal action since they are causing stress and dinging my credit score by charging money to an account they will not let me access and now saying it is 150 days late. Knocked my credit score down 100 pts.
  2. I apologize if this has been posted elsewhere but I didn't see it in the FAQs. So I have an old account on my credit report that appears to be well past the statute of limitations (last account activity was 2005). I sent a letter seeking verification from the collection agency and they sent copies of the original contract and all activity on the account. Nothing past 2005 there either. But they seem to think that I should still pay. I can't seem to find any advice online about what to do next and I don't want to reactivate this account by negligence. Thanks in advance.

Unfair or deceptive acts or practices. * * * (b.1) By debt collectors or creditors.--Notwithstanding the provisions of subsections (a) and ( , it shall constitute an unfair or deceptive debt collection act or practice under this act if a debt collector or creditor fails to provide a consumer with: (1) written verification of the debt or judgment, which notice contains the information specified in section 1692g(a) of the Fair Debt Collection Practices Act (Public Law 95-109, 15 U.S.C. § 1692 et seq.); and (2) when the applicable statute of limitations has expired on the debt or judgment or the debt or judgment is no longer legally enforceable, written notice of that fact
  4. So I went on Amazon and decided I would do an application to determine where I stood as far as creditworthiness was in their terms. In the meantime, I figured I would at least get the Equifax denial and have the right to request my Equifax report (which i will still do). Anyhow, I decided to fill out the Net 30 and Revolving application and then call in and play "the confused role" So I get a rep on the phone asking him if there was any primary difference in the two accounts outside of pay terms, and that to be safe I filled out both apps to let him fully process whichever I determined to go with. He states "Credit Review requirements are the same for both" So I told him to go ahead and see what we come up with. He puts me on hold for some time and then comes back giving me a reference code and telling me that he is transferring me to Verification department. When i got to her, she put me on hold for some time and also came and called the landline. After this about 10 minute process with her alone, she tells me Congratulations approved for $5000 (amount requested) At that point, I asked her which type of account she completed.. she stated that she did not know because once it hits her department, it is merely verification. *sigh* So I call back and talk to Net 30 customer service to see if thats the account I have (assuming this would be most logical) about whether it would be simple to convert over to Revolving account type.. another long hold session of course... then she gets me on the line with Credit Department Credit Department asks me if i want him to close the Net 30 Account .. WHOA BUDDY ... i told him that if he was able to simply approve the Revolving account in lieu of the net then we can close it.. (didnt want them to think i was going to overextend myself) however.. if we cannot simply open the Revolving account, then we will continue with the net account. 10 minutes holding COngratulations we were able to approve you for the Amazon.com revolving line of credit... $2500 limit.. SOOOO.... both lines opened simultaneously... net $5000 and Revolving $2500... Guess ill go ahead and try and get me a copy of my Equifax report since they should see the inquiry and ill just say i was DENIED...

Hi CB'ers, I have opted out and disputed my OLD ADDRESS that had a negative PAID account tied to it.TU and EQ deleted the address (EXP was not reporting the negative acct).So now am planning to DV the CA. Section 392.101 of the Texas Finance Code prohibits a third-party debt collector or credit bureau from engaging in debt collection in Texas unless the third-party debt collector or credit bureau has obtained a surety bond and filed a copy of the bond with the Office of the Secretary of State. You can verify if the CA has satisfied this requirement at the link below. Here! This is great ammo for dealing with those lovely folks who like to impersonate law enforcement and other shady tactics. Although the state attorneys will not take any action on your behalf in regards to a debt, it does apply pressure to the CA to clean up their act and move on to softer targets.
  7. In another thread I asked about what to do about a parking viloation I had that went to collections. The two prevailing ideas were to write a goodwill letter to the CA and then write verification letters to the CRAs. The ticket has already been paid, and some people said that sometimes the CA won't take the time to verify a debt that has already been paid. Regardless, everyone thought that a GoodWill letter was the best first step. My question is, is there any way that writing the GoodWill letter will help them verify the debt later if it comes to that? I've moved in the past year and the ticket is associated with an old address, so I'm wondering if somehow that can be used to make the debt hard to verify? I've already submitted letters to get my old addresses removed if that helps. Does anybody have any suggestions on how to proceede? I want to send the GoodWill letter but I'm worried that will somehow make the debt easier to verify. Thanks!
