  1. Hi All, This is my first posting and I appreciate any advice. My husband and I had a Citi card that was charged off in august of this year and we just received a call from a lawyer's office representing a CA (atlantic credit & finance). We have yet to receive anything in writing from them. We would very much like to negotiate for the best possible settlement, however we need some time (30-60 days) to come up with some cash to offer a settlement and in the meantime we are afraid of being sued by this lawyer as we do have some assests. We checked our CRs (all 3 via annualcreditreport.com), and neither the original account with Citi nor anything from Altantic is reported. I know in the past this Citi account was on the reports. We did notice that both the lawyer and Atlantic were listed recently as inquires. In your experience, how long to we have to negotiate before they file suit? Why would the original account with Citi not be on the report? We were expecting to see something along the lines of "sold $0 balance". When do such items get reported? Thank you for all your help!
  2. My scores just went from poor to fair two weeks ago. Last week I got two dunning letters (old overdraft and internet bill). AAARG!! Should I respond, or ignore and dispute if it shows up? The overdraft was never on my credit, but the internet bill was with a different CA, and was deleted in a dispute. I've read where a few people have responded to dunnings and were reported by the CA shortly after. I'd like to avoid that, and I don't have the money to pay either.
  3. I am in need of desperate help here. I am new to the creditboards forum and to the credit world. For years I avoided having credit cards and taking out loans, as this is the way that my mom and pop raised me. We did everything in cash. So here is my dilemma. I have read and re- read Whychat’s HIPPA program, warning I am so illiterate when it comes to credit reports and disputing things on it. So this is all foreign language to me. If I sound dum well I warned you lol I have this medical bill on my report by some CA. I owe $300.00 but they are reporting it as $350.00 ( I guess the $50 is their fee). I had no insurance at the time, so there is no EOB. I have taken the following steps so far: Opted out Requested my CR via mail and I was able to get it online I got my old addy’s deleted (only with TU), although nothing on my credit report is linked to the old addy’s Now I want to start the HIPPA program here is what I understand so far: Step 1 Dispute medical bill to all 3CRA wait to see if it is validated or not. NOW THIS IS WHERE IT GETS CONFUSING FOR ME: Once it comes back as verified do I contact the CA using the validation letter, sending cert. mail? Wait for a response from the CA? Then What? Contact the OC (hospital) with OR Contact the health care provider using “letter to health care provider” with the payment sending Cert mail. Then inform dispute with the 3 CRA as inaccurate reporting? OR Better yet can I just send payment to the health care provider with the HIPPA violation note, once I confirm that they did cash the MO, I can then dispute it with the 3 CRA as not reporting as valid? Oh boy this is quite overwhelming; I have faith that I will get it right!! Any help is appreciated. I am locked and loaded; I just need a target to shot my letters to!
  4. I have 3 AE corporate cards that where in my name for a corporation that I owned that closed in April of 2009. I recently received settlement offers that I can accept BUT they were in my name. I want to make the settlements in the corporation’s name for both tax and credit score reasons. 1. Do you think AE will settle with the corporation and remove me personally from the credit boards? How do I state that request? 2. The letters ask me to call 877-486-4966 before sending in the settlement offer. I have read on other sites that this is a debt collector and to not do business with them. How do I know if I’m really dealing with AE?
  5. myFICO report lists a collection as follows: The collection agency "496YC05020" was hired to collect a debt of $147 originally owed to "The York Water" on account number "XXXXXX". How do I know who to contact to validate debt if the agency listed are a bunch of letters and numbers?
  6. Hey guys. Question to help out the neighbor today. So in attempting to help her with her credit woes, she gave me some detail on a collection on the report and I figured I would dig for insight. The collection is for a broken lease at an apartment that she shared with her now Ex husband. The lease was in the ex husband's name... meaning he was the only APPLICANT, however, she had to be listed on the lease due to occupying the space. She never paid an application fee, had the credit ran or anything in order to do this. With the parties collecting on this lease, does it exclude her from being liable since she was on the lease but only due to being occupant. I could not find much information on this on the general internet so figured i'd see what our experts say. Thanks in advance for your help guys.
  7. I have a collection added to my report just yesterday, from an overlooked medical bill. I have no problem paying it off, but how should I go about paying for deletion. Do I need it in writing from the original debt owner?
  8. Hi there! I've been reading these forums for a bit now and finally decided to make a post - hopefully I can get some solid advice here. =] So my dad received a collection notice from ACSI (Automated Collection Services) regarding a debt from a private club he is a member of. (Short story: He retired and his balance went past due 31 days. Promised to pay as soon as his federal retirement kicked in within 2 weeks, but crazy club administrator who has a personal vendetta against him sent it to collections anyway). The amount they say he owed was relatively close to what was expected, but we wanted to be extra sure that everything was precise -- there's another member at said club with the same name and they accidentally charge HIS purchases to my dad's account from time to time. All of that being said, I sent a short, sweet DV letter to ACSI asking for an itemized list of the charges. They have a solid rep from what I've read so I figured they'd comply, and sure enough they did. Not only did they send an itemized list of charges from the club, but also the original signed application to join. Here's where the fun (read: questions) starts: 1. The itemized statement says $385 in monthly membership dues, but the application they sent with his signature specifically says $235. Disputable based on documentation THEY provided? 2. About a week and a half after the dunning notice was received, the OC (club) sent another invoice requesting payment. I could be wrong, but if the account it placed with a collection agency, isn't the OC supposed to stop dealing with the customer and refer them to the CA for questions and payment? It confused him because he now has 2 companies requesting payment for the same debt and doesn't know who to pay. 3. The debt needs to be (and is going to be) paid, mainly just waiting to see WHO actually gets the check. If the original creditor is paid, and we send a letter to the CA letting them know the OC kept sending statements after they had the account placed with them so we paid the club instead, the CA has to go away anyway, yes? And in that particular case, since we paid the OC by their request, can the CA still report it to the credit bureaus? Thanks in advance for any advice! =]

I've currently one Derogatory remark on my Credit Bureau for unpaid Medical Collection for $1200.00 from one year back which is causing my credit score to drop and negative remarks while apply for new credit. Actually i had set up make monthly payments with Collection agency for $50 a month and made 2 months of payments but still the CA went a head and remarked on my credit bureau. When i asked why it was reported even though i made payments they mentioned that it'll be removed once it completely paid off. I did not trust them they will remove it and stopped making payments. Now what are my options? Shall i trust CA and make payment for removing it or look at other option. I've read through some of the whychat'threads here and looks like i can dispute them but not sure of some details. I'm reading this http://www.whychat.5u.com/GUIDEBOOK.html but looks like lot of info there. 1st step is to Opt Out. Does it mean Send letters to the 3 credit bureaus (Experian, EQuifax & Transunion) asking them not to disclose my info? Am i missing anything here? Shall i Wait for 30 days after Opt Out? Get your credit reports directly from each Credit Reporting Agency, you need reports with an individual ID#. What is an Individual ID? I can get these reports without waiting 30 days from the above step...right Get your MIB report. What is this report? Do i need to get this? I did not move since the date of delinquency. So i don't need to delete Old address...right I'm not sure what i need to do after? Please advise and thanks in advance.
  10. Has anyone ever registered online through Cavalry Portfolio Service's website? It tells me it cannot find the account either by my SS#, the account number, or their case #. My most recent CMRRR was received by them on 7/15. Maybe they gave up, although account has not been deleted from CRs yet? Thoughts?

    EOS CCA

    Hello, I did a search for EOS CCA, or EOS, but nothing came up. Anyways, I am reviewing my reports, and this collection agency that is representing Verizon, has done something sneaky and pushed back their date of first delinquency at least 7 months from the actual delinquency. I know this is wrong because all of my bad accounts started around 7/2006, but they are reporting that my account went negative in 3/2007. So basically while all of my negative accounts are dropping off in August, they aren't going to drop off until March 2014. I have a feeling that they counted my first delinquency when they acquired the account, either that or they just are taking advantage of the system and reporting a later date so they can stay on my report and hound me to pay off the account What do I do about these guys???   13. I am just starting to work to repair my credit and have a charge on my credit report from Central FINL Control in Anaheim CA for $450.00 from 2007. What are my steps in having this taken off my report or settling without a negative impact? I am completely lost, any help or assistance will be greatly appreciated.
  14. Sooo, I started my credit repair journey about a month ago and have gotten a few collections removed. I have 2 medical collections by ucb. I sent ucb collections a dv letter using whychat's process for medical collections. They sent me a letter about 2 weeks ago saying they will no longer pursue me for payment and have ordered the all 3 cra's to remove the collections. HOWEVER, its been 2 weeks since and the collections are still reporting. I should also mention that these accounts are also in dispute with the cra's and the investigation isn't finished yet. I don't know what to do. How long should it take for it to be deleted? Any advice would be great!! :-)

  16. I have a collection agency reporting an alleged debt on my credit report. This has been reporting by them for a couple of years. Yesterday I received a credit alert that new potentially derogatory information has posted to my credit file. When I looked at my credit report the new information was the same alleged account that the agency had already been reporting. Will this new reporting affect my credit score? Can a collection agency re- report the same information?
  17. I need help please. I financed a car approx 6 years ago with a finance company that "specializes" in helping those with unfavorable credit. So I have a high interest rate but I needed a ride. Fast forward until last year. I had some financial setbacks and a couple of slow payments, then towards then end of the year I missed a payment or two. I looked into refinancing with a credit union, and was informed that I could, but they were showing that I had made all but one payment to the finance company. So I contacted the finance company and asked how was my balance approx still at $10,000 and I've made all but one payment. The rep said, oh, well you had some slow payments, and you missed a payment. I asked if they could send me my payment history and how they calculated the amount. I didn't get anything. I emailed them twice requesting it, didn't get it. Well, I didn't make any more payments. They started repossession. They have been unable to obtain the vehicle. Now I have received a letter from a lawyer's office stating they are attempting to collect the debt. I sent them a validation request. They sent me another letter just stating what the amount was, the name of the finance company, and a partial account number. I responded requesting once again validation- in bold, requesting a breakdown of how the amount was calculated. I also requested in the letters to cease repossession and collection attempts until that was provided. I haven't received anything else from the lawyers office, it's been 30 days. A couple of days ago I received an envelope with a card that said contact this person urgently, it had a phone number, but no company name or any other identifying information. I researched the address on the envelope, it was a repossession company. What can I do? All I want to know is how they came up with their amount. I have my contract, I can't figure it out. Is there any hope? Do they not have to provide that information to me? Any suggestions or advice on what my next steps should be?
  18. My GF received a letter today from Cavalry Portfolio Services regarding an old Old Navy account they purchased from GECRB. Or maybe they purchased it from someone else, but GECRB was OC. The collection also hit her most recent EQ and EX reports, but not TU. The letter was sent to an old address (we still own the home, just no longer live there) and was addressed to her married name (divorced several years). The letter states that due to the age of the debt, they will not sue. I think Ohio (where she lived at the time) has a long SOL on debts, but this is 5 years old or more, hard to tell as account itself is no longer on credit reports. Both her scores fell 40 points when this hit the files. I want to make sure we do exactly the right thing, as neither of us has much experience with this type of issue. Appreciate the help!
  19. I have a medical collection that was paid to the original creditor. I have been using Lexington law to remove paid collection they have been unable to do so. Previous to Lexington law, I hired an attorney to remove this collection and another medical collection. The attorney removed the other collection and removed the current collection from one of the three bureaus. One bureau never reported the collection so the paid collection is only being reported by Experian showing a zero balance. I have a paid receipt with a zero balance from the OC original creditor. How do I remove the collection with the HIPAA rules? I have been looking at the letters on why chat and I am confused on what to do. Do I send a letter to the collection agency using the validation/ dispute letter? Do I send the HIPAA letter to the original health care provider? Could some please help and tell me what to do? once that is done do I then send a letter the credit? What Letter? Thanks
  20. I'm beginning my journey to clean up my credit and after extensive research here I have a couple of options on how to remove 3 unpaid medical collections. I can DV the CA, go the HIPPA route through the CRA, or send the obsolete letter. They will fall off May 2014. I realize it may be a little too far out so maybe go the other route? Any suggestions? Any advice would be greatly appreciated.

  22. We recently decided to buy a condo and had just paid off all but 13% of the credit cards debt. I was waiting for the scores to jump up as my utilization was way above 80%. Then, couple days ago .... I looked at my credit and noticed a collection account on all 3 CRA's for a little over $800 from collection agency called Debt Rec Sol (Debt Recovery Solutions?). I think this was for a debt for an account I closed in 2006 (almost 7 years ago). I am in the State of Illinois and I think the SOL is 5 years here. I believe the debt is for a charged off checking account which is now gone (as of 10/2012) from ChexSystems. I have never received any paperwork from this company and believe I was previously able to delete accounts with this amount from all 3 CRAs. I understand that I should be sending them a DV letter but is there any faster way to deal with this since I believe this is past SOL in this state and I am in the process of getting a mortgage? ​I would appreciate any guidance in this matter.   23. I had used Lexington laws services to attempt to remove some late payments on my credit report. I used them for about 6 months I dropped them because they messed up my credit, but they were nice enough to charge me for one last month. Here is the situation: I had not been using an original creditor's,OC, department store card for 7 months. They were in the process of closing the card when I came into the store to use the card so instead ofreactivating the card they stared a new account. ( the new account is in good standing) The old account had all payments current and a zero balance. On my credit report the accounts show as paid or transferred (with one CRA) and current. 45 days ago that changed with Equifax it now shows as derogatory collection / charge off. There are late payments on that old account that are 21 months old, which Lexington law was attempting to remove but never removed them. Instead, they messed up the account turning it from positive account to derogatory collection / charge off. My score dropped 120 points. I contacted the OC via phone and they said the account was never charged off but they would not issue me a letter stating that fact, instead they said contact the CRA and have them contact us and we will verify with the CRA. Jst to verify I pulled a credit report directly from equifax and it is showing the account as closed and as a charge off. The account ha a zero balance and no late payments since 2011 Can anyone tell me What is the best fastest way to correct my credit to not show the derogatory collection/ charge off. Thanks
  24. I read on another board that collections accounts should not be reporting terms. I have two collection accounts that I am in the process of disputing. Both of these accounts are listed on my credit report as collection accounts and both term 1 month. I read that if I never entered into any type of agreement with the collection agency that this should not be listed with terms since no terms were agreed upon. Does anyone think this would be a valid and succesful way to dispute these items with the credit bureaus?
  25. Just wanted to thank CB for the wealth of info and advice. After quite a bit of reading I went after a five year old collection from IC System, from a Cox bill. Never received a dunning letter, so just sent a simple DV asking for proof that the debt was mine and that they were allowed to collect it. Haven't been home for a few days, so I just saw the response today: Dear Clive Warren, Please accept this letter as confirmation your account has been withdrawn from our files. We will request that any information our office may have forwarded to the credit reporting agencies regarding this account be deleted or removed from their records. You may wish to check with your local credit bureau to ensure that your credit file has been corrected. So happy about this. The only other negative accounts on my reports are medical collections, and I'm currently in the middle of Why Chat's hipaa program. CK is showing 0 derogatory marks, but it's pretty early, so I'm guessing they just don't show accounts that are in dispute. Thanks CB!
